When a permit is required
Permit triggers and exempt work for Middlebury
A zoning permit is required before any land development, including: new construction of any structure; additions; alterations that change footprint, height, use, or building systems; change of use; new accessory structures (with limited exceptions); parking/driveway changes; excavation or fill; signs; demolition.
- Exempt Residential fences and walls (of any height)
- Exempt Ground-level unroofed patios, decks, entry steps, and accessible ramps (at grade)
- Exempt Roof-mounted residential solar panels (no footprint change)
- Exempt One small accessory structure per property up to 100 sq. ft. and 10 ft. high (if setbacks are met)
- Exempt Small residential pools under 3 feet deep
- Exempt Rental of two or fewer rooms in an owner-occupied primary residence
- Exempt Interior work that does not change use or add dwelling units
- Exempt Routine maintenance and minor repairs (no footprint change, no change of use)
- Exempt Holiday light displays (temporary)
- Exempt Public art not used for advertising purposes
- Exempt Certain solar canopies over parking lots (conditions apply)
- Exempt Mobile food service for invitation-only private events of up to 3 days
Note: Some items exempt for residential use are NOT exempt for commercial use (e.g., steps/ramps over 3 feet high). Confirm with the Zoning Administrator for any borderline project.

- 2025 Vermont Fire and Building Safety Code (state code, applies to commercial and rental buildings); Middlebury Zoning and Subdivision Regulations (effective September 13, 2022); Vermont Residential Building Energy Standards (RBES) and Commercial Building Energy Standards (CBES).
- Permit validity
- Permits are valid for 2 years from issuance. Permits not acted on within 2 years expire and must be reapplied for.
- Owner-builder
- No specific owner-builder exemption from local zoning permit requirement. Single-family owner-occupied homes are generally exempt from the DFS state construction permit (but not from local zoning requirements).
- Contractor requirements
- Vermont does not license general contractors statewide. State licenses required for electricians, plumbers, and mechanical contractors.
Application process
Typical processing: Administrative permits typically issued within a few business days of a complete application. Complex or DRB-referred projects take longer.
- 01 Determine whether a zoning permit is required for the project. Contact the Zoning Administrator at permits@townofmiddlebury.org or 802-388-8100 ext. 226.
- 02 Download and complete the Zoning (Building) Permit Application.
- 03 Prepare required supporting documents: owner signature, project/use description, sketch or site plan showing lot boundaries, proposed structure, setbacks, and dimensions.
- 04 Calculate the applicable fee using the Construction and Development Fee Schedule.
- 05 Submit application by email, mail, or drop box at 77 Main Street, 1st Floor.
- 06 The Administrative Officer (Zoning Administrator) acts within 30 days of a complete application by approving, denying, or referring to the Design Advisory Committee and/or Development Review Board (DRB). If no action within 30 days, permit is deemed approved.
- 07 If approved, the zoning permit card is issued. Post the yellow permit card visibly at the property within 3 days of issuance.
- 08 Wait for the 15-day appeal period to pass before beginning work or occupancy.
- 09 Upon project completion, notify the Administrative Officer to schedule a final inspection. A Certificate of Occupancy is required before new dwellings, conversions, or substantially altered commercial structures are occupied.
