When a permit is required
Permit triggers and exempt work for North East
A Town zoning authorization is required for any project that alters the inside or outside of an existing structure, changes the use of property, expands the size of an existing structure, or adds a new structure. Specific categories include decks, garages, sheds, driveways, additions, new structures, pools, walkways, and signs. Fences require both a zoning authorization and a separate fence permit.

Note: Any work that alters structure interiors or exteriors, changes property use, expands structures, or adds new construction requires authorization regardless of scope. Properties in the 100-year floodplain have additional restrictions and are not entitled to some standard exemptions.

- Cecil County building permit rules apply -- valid one year from issuance, work to commence within 180 days, up to two six-month extensions.

- 01 Determine whether the project requires a Town of North East Construction/Zoning Authorization. Zoning Authorization Applications are required for: decks, garages, sheds, driveways, additions, new commercial or residential structures, pools, walkways, signs, and fences (separate fence permit also required). Food carts and temporary seasonal sales also require authorization.
- 02 Review the relevant zoning articles in the North East Zoning Ordinance and consult with the Planning Director if needed to avoid delays.
- 03 Download the Construction/Zoning Authorization Application from the Town website or obtain it at Town Hall, 106 South Main Street.
- 04 Submit the completed application with required supporting documents (plot plan, dimensions, setbacks, description of work) to Town Hall. Pay the $35.00 Zoning Authorization Application fee.
- 05 The Town Planning and Zoning Department reviews the application for compliance with the North East Zoning Ordinance, Chesapeake Bay Critical Area regulations, floodplain requirements, and forest conservation rules.
- 06 Receive the approved Zoning Authorization package from the Town.
- 07 Bring the approved package to the Cecil County Division of Permits and Inspections, 200 Chesapeake Boulevard, Elkton, and apply for the county building permit via the OpenGov portal.
- 08 Construction cannot commence until the county building permit is approved and issued.
- 09 Schedule required county inspections with 24 hours advance notice.
