When a permit is required
Permit triggers and exempt work for Carlsbad
State and city law requires design approval and plan check before a building permit issues. Most construction work requires permits; exemptions are listed in municipal code rather than in a single short list.
- Exempt City notes that most work requires a permit and directs to municipal code exemption section for the definitive list. Refer to CMC 18.04.015 for current municipal-code-specific exemptions. Grading/work disturbance has separate exemptions (for certain small-volume excavation thresholds) in building application materials.
Note: Exemption does not waive other required city, county, or utility approvals. Any exempt scope touching setbacks, occupancy, structure, utilities, or Right-of-Way may still trigger permits or fees.
- Residential Permit Application (B-1) with signatures and ownership/applicant details. Construction plans (minimum three sets for many projects), title sheet/site plan, and project scope details. Applicable specialist forms (e.g., climate action, waste, erosion/water, school, grading, boundary certification) as required by project type/value. Contractor/owner identity documentation (owner-builder declarations or contractor license/proof where needed).
- Building code
- City follows the California Building Standards/California Building Code framework and city-specific adopted standards under municipal code Ch. 18.04; see codes/standards links.
- Permit validity
- Permit applications can be deemed abandoned after 365 days. Once issued, the permit is valid for the approved scope, with completion expected within 3 years. Expired permits can trigger reinstatement or reapplication requirements.
- Owner-builder
- Homeowner may apply as owner-builder using B-1 and required owner-builder declaration/acknowledgement forms. If an agent files on owner’s behalf, an authorized-agent form is required.
- Contractor requirements
- Contractor applicant must provide proof of current contractor license, workers’ compensation coverage, and City business license.
