When a permit is required
Permit triggers and exempt work for Eureka
Building permits are required for most construction, alteration, repair, demolition, grading, solar, tenant improvement, addition, new construction, and similar work unless the work falls under an exemption. Separate permits may be needed for work in the public right-of-way and for utility or sewer connections.
- Exempt One-story detached accessory structures not over 120 square feet
- Exempt Fences not over 7 feet high
- Exempt Retaining walls not over 4 feet high unless supporting a surcharge
- Exempt Water tanks on grade up to 5,000 gallons if they meet code ratios
- Exempt Sidewalks and driveways
- Exempt Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
- Exempt Prefabricated swimming pools less than 24 inches deep
- Exempt Swings and playground equipment
- Exempt Window awnings meeting the City handout limits
- Exempt Detached decks not exceeding 200 square feet, not more than 30 inches above grade, not attached to a dwelling, and not serving the required exit door
- Exempt Listed temporary decorative lighting and other minor electrical repair items in the handout
- Exempt Portable heating, cooking, and clothes-drying appliances and other minor gas, mechanical, or plumbing work listed in the handout
Note: Exemptions do not authorize work that violates any code, law, or ordinance. Emergency replacement or repair work still requires a permit application by the next working business day. Ordinary repairs lose exemption status if they involve structural removal, egress changes, or new or relocated plumbing, electrical, gas, sewer, or mechanical work affecting public health or safety.
