When a permit is required
Permit triggers and exempt work for South Hero
Zoning permit required for all land development including new structures, moving a structure, additions/expansions, new land uses, changes of use, grading, excavation, and fill. Construction may not begin until any required State Water/Wastewater Permit has been issued.
- Exempt Required agricultural practices and farm structures (farmer must give written notice to ZA with sketch and setbacks, but no zoning permit required)
- Exempt Accepted silvicultural practices and forestry operations
- Exempt Utility generation/transmission facilities regulated under 30 V.S.A. sec. 248
- Exempt Hunting, fishing, and trapping activities
- Exempt Interior-only changes with no change of use
- Exempt Minor repairs that do not change exterior dimensions or height
- Exempt Residential fences and walls under 6 feet
- Exempt Small incidental structures up to 100 sq ft / 10 ft high without permanent foundations
- Exempt Signs within applicable sign regulations
- Exempt Garage/yard sales
- Exempt Driveway resurfacing
- Exempt Some small-scale grading and excavation (specific thresholds -- confirm with ZA)
Note: In the Flood Hazard Overlay District, all construction and development requires a zoning permit regardless of the above exemptions.

- Site plan showing property lines, lot dimensions, existing and proposed structures with dimensions, setbacks from property lines and from water/wetlands, driveways, and utilities
- VTrans State Highway Access Permit letter of intent if project is on or near a state highway
- Evidence of state wastewater permit or proof one is not required
- Evidence of Vermont Shoreland Protection Act permit or registration if within 250 feet of Lake Champlain
- Evidence of any required Act 250 permit

- Vermont Fire and Building Safety Code (2025, 2021 IBC base) via Vermont DFS; RBES/CBES for energy. South Hero's Development Regulations (effective January 1, 2024) govern land use and dimensional standards.
- Permit validity
- 2 years from issuance; ZA may grant 1-year extension on written request. Certificate of occupancy required before use or occupancy.
- Owner-builder
- Same as Vermont statewide: no general contractor license required; residential contractor registration required for residential projects over $10,000; electricians and plumbers must be state-licensed except for owner-builder exemption in owner-occupied single-family residences.
- Contractor requirements
- Residential contractor registration required for work on 1 to 4 dwelling units totaling more than $10,000. Electricians and plumbers must be state-licensed with limited owner-builder exemptions.

Application process
Typical processing: 30 days maximum for ZA action on complete applications. DRB review adds additional time.
- 01 Call or email the Zoning Administrator at 802-372-4841 or zoning@southherovt.org to discuss the project and confirm requirements.
- 02 Determine whether your project is a use permitted by right (ZA issues directly) or requires Development Review Board review.
- 03 Download the South Hero Zoning Permit Application form from https://southherovt.org/documents-and-forms/ or obtain from town office.
- 04 Gather required documents including site plan and evidence of state permits.
- 05 If within the Flood Hazard Overlay District, contact the ZA about additional state/federal requirements.
- 06 If within 250 feet of Lake Champlain, initiate Vermont DEC Shoreland Protection Act permit or registration in parallel.
- 07 Submit complete application and fee to the ZA. Application is not complete until both application form and fee are received.
- 08 If DRB review is required, the ZA refers the application. DRB gives at least 15 days' public notice before hearing.
- 09 ZA must issue, deny, or refer within 30 days of a complete application. If ZA fails to act within 30 days, permit is deemed issued on day 31.
- 10 Upon issuance, applicant posts the permit notice near public right-of-way for 15 days.
- 11 Permit becomes effective after 15-day appeal period with no appeal.
- 12 Commence construction only after permit is effective and any required state permits are obtained.
- 13 Upon completion, apply for and obtain a Certificate of Occupancy before using or occupying the development.
