When a permit is required
Permit triggers and exempt work for North Hero
All land development including new structures, additions/expansions, decks, ramps, signs, moving a structure, and changes in land use require a permit. Fences 6 feet or less and handicapped access structures are exempt unless in Flood Hazard Overlay District.

Note: Accessory structures listed as Permitted (P) in Table 5.1, meaning allowed but still requiring a permit. All construction and development in the Flood Hazard Overlay District requires a permit regardless of exemptions.

- Vermont Shoreland permit or registration if within 250 feet of Lake Champlain

- Vermont Fire and Building Safety Code (2025, 2021 IBC base) via Vermont DFS; RBES/CBES for energy; North Hero Development Regulations 2023 for local land use and dimensional standards.
- Permit validity
- Review current Development Regulations 2023 for specific validity periods. Contact ZA for current policy.
- Owner-builder
- Same as Vermont statewide: no general contractor license required; residential contractor registration required for residential projects over $10,000; electricians and plumbers must be state-licensed with owner-builder exemptions for owner-occupied single-family residences.
- Contractor requirements
- Residential contractor registration required for work on 1 to 4 dwelling units totaling more than $10,000. Electricians and plumbers must be state-licensed with limited owner-builder exemptions.

Application process
Typical processing: 30 days maximum for ZA action. DRB review adds additional time.
- 01 Contact Zoning Administrator (Danielle Turin, 802-372-6926 ext. 6) on Wednesday or Friday 9:00 AM-12:00 PM to discuss the project and confirm requirements.
- 02 Download or obtain the Building Permit Application from the town forms page or Municipalone portal.
- 03 Determine whether ZA can issue directly (permitted uses) or DRB review is required.
- 04 Prepare site/map sketch, structure dimensions, distances to property lines, wetlands, and water features.
- 05 Identify applicable state approvals: wastewater/potable supply permit, shoreland permit or registration, wetland permit, VTrans driveway permit if applicable.
- 06 Submit complete application and fee to the ZA online or in person.
- 07 All fees are due within 30 days of approval.
- 08 ZA must act within 30 days of complete application. If ZA fails to act within 30 days, permit is deemed issued on day 31.
- 09 If DRB review is required, public hearing is scheduled with at least 15 days' notice. DRB decision due within 45 days of hearing.
- 10 Upon issuance, permit is posted and the 15-day appeal period runs.
- 11 Permit becomes effective after the appeal period expires.
- 12 Commence construction after permit is effective and state permits are in hand.
- 13 Complete work and contact ZA regarding required certificate of compliance/occupancy.

All fees due within 30 days of permit approval. Recording fee ($15) applies to all permit types. Fee schedule effective January 1, 2025.
