When a permit is required
Permit triggers and exempt work for Isle La Motte
Local permit required ONLY for development in the Special Flood Hazard Area (below BFE 102 feet). No general local building permit for properties outside the SFHA.

- Exempt Ordinary maintenance and repair within exact same footprint in the SFHA (subject to NFIP substantial improvement calculation rules)
- Exempt Agricultural practices (no local land use regulation beyond SFHA)
- Exempt Silvicultural/forestry operations
Note: Isle La Motte is unique in having no general municipal zoning. The Flood Hazard Ordinance is the only local permitting authority. Even where no local permit is required, state permits (DFS, shoreland, wastewater, Act 250) may still apply.

Application process
Typical processing: Confirm with town clerk. Vermont flood ordinance practice allows permit to issue after ANR NFIP Coordinator review or 30 days, whichever comes first.
- 01 Determine whether your parcel is within the Special Flood Hazard Area (SFHA) by checking FEMA FIRM map (effective April 15, 1980; Base Flood Elevation 102 feet for Lake Champlain area).
- 02 If OUTSIDE the SFHA: No local building permit required. State permits may still apply (DFS for public buildings, shoreland, wastewater, Act 250).
- 03 If INSIDE the SFHA (all shoreline and much of interior): Contact Town Clerk at 802-928-3434 or townclerk@islelamotte.gov to obtain flood hazard permit application.
- 04 Prepare site plan showing existing and proposed structures, elevations, distances from water, fill/grading information.
- 05 If project is substantial improvement (construction value exceeds 50% of pre-improvement assessed value), prepare elevation documentation showing proposed lowest floor elevation relative to BFE (102 feet).
- 06 For construction below 98 feet, obtain Army Corps of Engineers approval.
- 07 If within 250 feet of Lake Champlain mean water level, obtain Vermont DEC Shoreland Protection Act permit or registration in parallel.
- 08 Submit flood hazard permit application to town. Permit required before construction begins.
- 09 Vermont ANR NFIP Coordinator review applies to substantial improvement and new construction in SFHA.
- 10 For public buildings, obtain Vermont DFS state construction permit from Williston regional office.
- 11 Obtain Vermont wastewater/potable water permit from Vermont DEC if applicable.
- 12 Determine Act 250 applicability: Isle La Motte is a 1-acre municipality; Act 250 triggers at improvements over 1 acre within 5-mile radius.
