When a permit is required
Permit triggers and exempt work for Lopatcong Township
Building permit required for all construction within Lopatcong Township except for work specifically exempted by N.J.A.C. 5:23-2.14.
- Exempt Ordinary maintenance: Non-structural replacement-in-kind, painting, wallpapering, floor covering
- Exempt Sheds: Utility sheds 200 sq ft or less, 10 feet or less in height, no utility connections
- Exempt Fences: Six feet or less in height (except pool barriers)
- Exempt Temporary structures: Less than 120 sq ft, in place less than 180 days
- Exempt Retaining walls: Less than 4 feet in height (unless impacting foundation)
Note: Zoning clearance may still be required for exempt work. Contact Township Zoning Officer to confirm.
- Zoning permit application (for Township approval)
- Sealed survey or plot plan showing existing and proposed structures, setbacks, septic/well locations
- UCC construction permit application with applicable subcode sections (for State Office)
- Construction plans and documentation

- Permit validity
- 12 months from the date of the last inspection per N.J.A.C. 5:23-2.18.
- Owner-builder
- Owner-builders may prepare plans for their own single-family dwelling.
- Contractor requirements
- Contractors must be properly licensed. Building contractors cannot prepare drawings unless licensed as architect or engineer.
Application process
Typical processing: 20 business days for State Office plan review; additional time for Zoning permit processing.
- 01 Contact Township Zoning Officer to determine if zoning permit required: 908-859-3355 or zoning@lopatcongtwp.org.
- 02 If zoning approval needed, submit scaled plot plan or survey showing location of existing and proposed structures and setbacks.
- 03 Obtain zoning clearance from Township before proceeding to construction permit step.
- 04 After zoning approval, contact State Office of Local Code Enforcement at 171 Route 173, Suite 101, Asbury, NJ 08802 (908-713-0722).
- 05 Submit UCC construction permit application with all applicable subcode sections to State Office.
- 06 Pay construction permit fees to State Office.
- 07 State Office conducts 20-business-day plan review for complete applications.
- 08 Schedule and pass required inspections conducted by State Office.
Typical processing time: 20 business days for State Office plan review; additional time for Zoning permit processing.
