When a permit is required
Permit triggers and exempt work for San Juan Capistrano
Required, with stated exceptions, whenever a building or structure or any electrical, plumbing, or mechanical system is erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted, or demolished.
- Exempt One-story detached accessory buildings such as tool sheds, storage sheds, and playhouses not over 120 square feet, subject to zoning setback and height rules and Fire Code compliance.
- Exempt Wood, vinyl, wrought iron, or similar fences not over 7 feet high; masonry or concrete fences not over 36 inches in height, measured as stated by the City.
- Exempt Sidewalks and driveways.
- Exempt Retaining walls not over 48 inches in height unless supporting a building or slope surcharge, located at the top of a slope, or impounding Class I, II, or II-A liquids.
- Exempt Decks, platforms, walkways, sidewalks, and driveways not more than 30 inches above adjacent grade, not over a basement or story below, and not part of an accessible route.
- Exempt Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work when the work does not involve structural changes or electrical, mechanical, or plumbing relocation/addition/modification.
- Exempt Prefabricated above-ground swimming pools accessory to Group R-3 occupancy that are less than 18 inches deep and do not exceed 5,000 gallons.
- Exempt Shade cloth structures for nursery or agricultural purposes, excluding service systems.
- Exempt Swings and playground equipment accessory to detached one- and two-family dwellings.
- Exempt Window awnings for Group R-3 and U occupancies that project no more than 54 inches and need no additional support.
- Exempt Non-fixed and movable fixtures, cases, racks, counters, and partitions not over 5 feet 9 inches in height.
Note: The City states exempt work must still comply with applicable code and zoning standards, and other permits or technical review may still be required. The exemptions page cites California Building Code Appendix Chapter 1 and San Juan Capistrano Municipal Code Title 8, Chapter 2.

- Building code
- The City states the 2025 California Building Standards Code went into effect January 1, 2026, including the 2025 California Building, Mechanical, Electrical, Plumbing, Existing Building, Fire, Energy, Residential, Green Building Standards, and Historical Building Codes, plus the San Juan Capistrano Municipal Code.
- Permit validity
- A permit application expires 1 calendar year after filing unless a permit is issued or an extension is approved by the Building Official before expiration, provided adopted codes have not changed.
- Owner-builder
- The City uses an Owner-Builder Property Owner's Package and will not issue an owner-builder permit until the owner-builder acknowledgment is completed and returned. The property owner assumes legal and financial responsibility for the project, may have employer obligations if using unlicensed workers, and must verify contractor licensing and workers' compensation coverage. A copy of the property owner's driver's license, notarization, or other acceptable verification is required when the permit is issued.
- Contractor requirements
- Contractors are required by law to be licensed and bonded in California and to list license numbers on permits and contracts. The City permit application collects contractor license number and class. The City also states each contractor or subcontractor must have a current and valid City of San Juan Capistrano business license to perform work in the City. For Symbium instant residential solar/ESS permits, the applying contractor must hold license B, C-10, or C-46 and have an active City business license.

Typical processing: Building first review target 12 working days; Building resubmittals/revisions 7 working days; Planning 5 working days; Engineering 20 working days; qualifying Symbium applications processed for permit issuance within 5 business days after submittal.
- 01 Determine whether the project requires a permit and whether outside-agency approvals are needed. The City states permits are required, with some exceptions, whenever a building or structure or any electrical, plumbing, or mechanical system is erected, enlarged, altered, repaired, moved, improved, removed, converted, or demolished.
- 02 Prepare the submittal package. A completed Building Permit Application is required for all permit submittals, along with the applicable OCFA residential or commercial checklist. Plan check requirements call for 24 inch by 36 inch plans and project-specific supporting documents.
- 03 Obtain any prerequisite outside approvals before issuance. The City identifies typical reviews from OCFA, SMWD, AQMD, OCHCA, and HOA/CC&R. For work in the public right-of-way, a separate Engineering encroachment permit is required.
- 04 Submit the application using the path that matches the project type. New construction permit applications must be submitted electronically; tenant improvements and residential remodels must be submitted as hard copy in person at City Hall by appointment; qualifying residential solar and energy storage permits may use the Symbium automated platform.
- 05 Pay plan check fees at submittal. The City states plan check fees are calculated and due at the time of submittal, and the City does not offer expedited review.
- 06 Track review status in eTRAKiT and respond to corrections or resubmittal requests. Published target review times are 12 working days for first Building review and 7 working days for Building resubmittals/revisions. Planning review is listed at 5 working days and Engineering review at 20 working days, with housing project engineering reviews at 15 working days.
- 07 After approvals and fee payment, obtain permit issuance. For Symbium approvals, the City says issuance is typically processed within 5 business days after application submittal, then the applicant receives an invoice, signs the permit, and receives the permit, job card, and approved documents by email.

San Juan Capistrano building permit fees
Plan check fees are calculated and due at submittal; applicants are directed to Finance at 949-487-4300 for acceptable forms of payment. For Symbium permits and revisions, invoices are emailed to the applicant and the permit or approved revision is released after fees are paid.

- Inspection hours
- Inspection requests must be made before 4:00 pm on a City business day for the next business day. Timeframes are posted by 8:00 am on the day of inspection. Requested windows are AM 8:00 am to 12:00 pm and PM 12:00 pm to 3:30 pm, but the City says requested timeframes are not guaranteed.
Typical sequence: After permit issuance, construction may begin. Inspections are required before any work is covered or concealed. The contractor or owner is responsible for scheduling required inspections, keeping approved plans and the job card on site, and obtaining final approval before project completion. For Symbium solar permits, the City notes a stand-off inspection before final for solar PV systems and additional inspections for battery storage systems as applicable.
