When a permit is required
Permit triggers and exempt work for Dana Point
Dana Point states permits are required for almost all construction, including bathroom and kitchen renovations, deck and guardrail repairs/replacements, additions, alterations, and changes to structural components. Work in the public right-of-way requires an encroachment permit.
- Exempt One-story detached accessory structures such as tool sheds or playhouses up to 120 square feet, subject to zoning and fire requirements
- Exempt Masonry or concrete fences up to 36 inches high, and other fences up to 6 feet high, except where a permit is required as a project approval condition
- Exempt Oil derricks
- Exempt Retaining walls up to 3 feet high measured from bottom of footing to top of wall, unless supporting surcharge or impounding certain liquids
- Exempt Water tanks directly on grade up to 5,000 gallons within the stated height-to-width ratio
- Exempt Certain low decks, platforms, walkways, sidewalks, and driveways not over 30 inches above adjacent grade, not over a basement/story below, not attached to the structure, and not part of an accessible route
- Exempt Painting, papering, tiling, carpeting, and similar finish work that does not involve electrical, mechanical, or plumbing work
- Exempt Temporary motion picture, television, and theater stage sets / scenery
- Exempt Above-ground prefabricated pools accessory to Group R-3 occupancy that are less than 18 inches deep and not over 5,000 gallons
- Exempt Shade cloth structures for nursery or agricultural purposes, excluding service systems
- Exempt Swings and playground equipment accessory to detached one- and two-family dwellings
- Exempt Limited window awnings and movable/non-fixed fixtures, counters, racks, partitions, antennas, and flagpoles meeting the City's size limits
Note: Separate plumbing, electrical, and mechanical permits may still be required even where the building work itself is exempt. Dana Point also notes that site-specific conditions in bluff-top lots, floodplain properties, Town Center areas, or areas with prior land movement can change requirements.
- At minimum, an electronic permit application and required digital plans/documents through eTRAKIT. Depending on scope, the City also requires proxy forms instead of authorization letters, contractor license information, worker's compensation proof if applicable, soils reports for many foundation projects, and other trade-specific submittals. For permit carriers using proxy forms, the City requires identification and contractor license documentation.
- Building code
- Effective January 1, 2026, Dana Point adopted the 2025 California Building Code, 2025 California Residential Code, 2025 California Electrical Code, 2025 California Mechanical Code, 2025 California Plumbing Code, and 2025 California Green Building Standards Code, with local amendments through the Dana Point Municipal Code. The City also applies the California Energy Efficiency Standards under Title 24.
- Permit validity
- Under Dana Point's 2025 code update ordinance, permit applications are deemed abandoned after 180 days unless pursued in good faith or issued. Once issued, a permit expires if work is not commenced within 12 months (365 days), or if required progress inspections do not receive substantial approval for 6 months (180 days). Written extensions may be available.
- Owner-builder
- A homeowner of record may obtain a permit for work on a one- or two-family dwelling and accessory structures if the owner resides or intends to reside there, performs the work, and signs the required statement regarding workers' compensation exposure. Identity and ownership/residency must be verified. Dana Point also uses an Owner-Builder Verification and Acknowledgment form.
- Contractor requirements
- Contractors must hold a valid California contractor's license in good standing. If the contractor has employees, proof of workers' compensation insurance is required at permit issuance. Contractors working alone may waive that proof but must show a pocket copy of the state license. Dana Point does not accept letters of authorization; only approved Contractor Proxy or Owner Proxy forms.
Application process
Typical processing: Dana Point publishes same-day-style OTC review only for minor projects/revisions requiring 15 minutes or less of review; it does not publish a general turnaround for standard building plan review on the main permit pages reviewed.

- 03 For minor OTC-eligible projects or revisions needing 15 minutes or less of review, the City processes them through online OTC review. Larger projects proceed through regular plan review.
- 04 Respond to plan review corrections if issued and obtain all required department clearances.
- 05 Pay permit and plan check fees through the City process. Dana Point warns that it does not request or accept payment by wire transfer.
- 06 After permit issuance, keep approved plans on site, schedule required inspections, and obtain final approval / certificate of occupancy if applicable.

- Inspection hours
- Inspections are normally performed between 8:00 AM and 4:00 PM, though they may occur earlier or later based on workload. Two-hour windows are posted online the night before. Inspectors' office hours are 7:30 AM to 8:30 AM Monday through Friday. Construction hours are 7:00 AM to 8:00 PM Monday through Saturday; no work Sundays or federal holidays.
Typical sequence: Dana Point schedules inspections at project progress benchmarks. The City's IVR list shows common building stages such as soils/underground, foundation/footings/UFER, slab on grade, framing, insulation, drywall/lath, MEP roughs, and final inspections, with separate mechanical, electrical, plumbing, pool/spa, engineering, and planning inspection codes.
