When a permit is required
Permit triggers and exempt work for Oakland
Oakland requires permits to perform construction on buildings or structures, and the building permit application/declaration forms cover construction, alteration, improvement, demolition, repair, occupancy changes, and related trade work. Permits may also be needed from other Oakland departments depending on the project.
- Exempt One-story detached accessory structures used as tool and storage sheds, playhouses, and similar uses not over 120 square feet
- Exempt Concrete or masonry fences not over 3 feet high, and other fences not over 7 feet high
- Exempt Oil derricks
- Exempt Retaining walls not over 4 feet high unless supporting a surcharge or impounding certain liquids
- Exempt Water tanks on grade not over 5,000 gallons with qualifying height-to-width ratio
- Exempt Sidewalks and driveways not over 30 inches above adjacent grade and not over a basement or story below
- Exempt Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
- Exempt Prefabricated swimming pools accessory to Group R-3 occupancy that are under 24 inches deep, do not exceed 5,000 gallons, and are installed entirely above ground
- Exempt Swings and playground equipment accessory to detached one- and two-family dwellings
- Exempt Window awnings supported by an exterior wall in Group R-3 or U occupancies that project no more than 54 inches and do not require additional support
- Exempt Decks not more than 30 inches above grade at any point, not attached to a dwelling, and not serving a required exit door

Note: Oakland's exemption handout says exemptions do not authorize work that violates code or other laws. Planning or zoning permits may still be required even when a building permit is not. The exemption list also does not waive permits for work affecting safety, structure, egress, or other code-triggering conditions.

- Building code
- Oakland adopts the California Building Standards Code through Title 24 with local Oakland amendments. Current City materials and the FY 2025-26 fee schedule reflect the 2025 code cycle effective January 1, 2026.
- Permit validity
- Oakland states applications are valid for 180 days from the file date. After issuance, the permit becomes invalid if required progress is not maintained; the City's status guidance says permits are valid for 180 days from issuance unless a major inspection is approved or partially approved and then at least every 6 months thereafter. Expired permits can be extended or reinstated by request.
- Owner-builder
- Oakland has an Owner-Builder's Declaration and owner-builder user agreement. The owner must sign the declaration, acknowledge the licensing and liability rules, and confirm they are either doing the work themselves or contracting with licensed contractors. Oakland warns owner-builders they may be treated as employers and may be liable for worker injuries and latent defects.
- Contractor requirements
- Oakland requires a current California contractor license in the proper classification, current workers' compensation information, and a current City business license for contractors obtaining permits. Contractor declarations are required in the permit process.

Typical processing: Oakland's current turnaround page says simple no-plan permits such as water heater replacement, main service upgrades, and furnace replacement are typically same day; many homeowner repair/remodel permits with no engineer review are same day or up to 2 weeks; intake projects with engineer review are about 10 days up to 3 weeks; overall building projects average about 19 days.
- 01 Confirm the project scope, zoning, and whether Oakland requires only a Building Worksheet, a full plan check, or other reviews such as Fire, Transportation, or Planning.
- 02 Create an account in Oakland's Online Permit Center.
- 03 Submit the application or Building Worksheet online and upload all required documents electronically. Oakland states paper documents are not accepted for Planning & Building submittals.
- 04 Pay the required application fees. Oakland states an application is only completely submitted for processing after materials are received and fees are paid.
- 05 City staff performs intake. If plans are required, the application moves to plan review; if corrections are needed, respond and resubmit through the portal.
- 06 After all required reviews are approved and remaining fees are paid, Oakland issues the permit by email.
- 07 Keep approved plans and the job card at the site, schedule inspections, complete required sign-offs, and obtain final approval.

Fees can be paid online through the Online Permit Center; Oakland also lists Cashier phone support at (510) 238-4774. Permit issuance occurs after approvals and payment. The cashier page states credit card payments are accepted, and the citywide fee schedule includes a $3.00 credit card convenience fee per transaction.
