When a permit is required
Permit triggers and exempt work for Abernathy
Permits are required for new houses, manufactured homes, mobile homes, accessory buildings over 200 square feet, additions or alterations to existing residential or commercial buildings, swimming pools, fences, window replacements, driveway approaches, and similar listed work. A separate floodplain development permit is required before development in a FEMA special flood hazard area.

- Permit validity
- Permits expire if work has not started within 180 days, or if work stops for 180 days. One written extension may be requested before expiration.
- Owner-builder
- A homeowner may perform construction work on the homeowner's homestead without a license if the home is not being built or remodeled with the specific intent of selling within the next 12 months. The homeowner must not have obtained or held homeowner permits at three different addresses within any two-year period.
- Contractor requirements
- Construction must be performed by licensed and/or registered contractors where applicable. Plumbers, electricians, and mechanical contractors must be licensed by the State of Texas. Contractors working on HVAC, electrical, plumbing, or fire sprinkler systems must show TDLR licensure before any inspection. Irrigation contractors must hold a TCEQ license.

Application → plan check → issuance → inspection → final
- 01 Confirm the property is inside Abernathy city limits and verify it is in the Hale County portion of the city.
- 02 Create a Cloudpermit account and submit the building permit application through the city portal.
- 03 Upload required submittals including complete set of plans and specifications, foundation detail, plat showing property lines and existing/proposed construction, and Texas Architectural Barriers registration for commercial projects valued over $50,000.
- 04 If the project is in a FEMA special flood hazard area, obtain a floodplain development permit and provide required floodplain technical submissions.

- 08 Obtain final inspection approval and any required certificate of occupancy before occupancy or use.

Permit fees must be paid with submission of the application. If a permit is not issued, the amount paid is refundable. Once the permit is issued, the amount paid is nonrefundable.
