When a permit is required
Permit triggers and exempt work for Harney County
A structural building permit is required for all new construction, structural alterations, and repairs to residential and non-residential buildings in unincorporated Harney County. Building permits are NOT required for permit-exempt work as defined by the Oregon State Building Code.
- Exempt Detached, nonhabitable, one-story accessory structures under 200 sq ft and under 15 ft average roof height (e.g., small sheds, unfinished storage)
- Exempt Decks not more than 30 inches above grade (single story, single-family only)
- Exempt Certain patio/porch/deck covers up to 200 sq ft
- Exempt Fences under 7 ft tall
- Exempt Window/door replacements with no structural work
- Exempt Some like-for-like repairs if no structural/load-bearing changes occur
Note: Work exempt from structural permit may still require separate electrical, plumbing, or mechanical permits. Heated accessory structures must comply with habitability definitions. All exempt work must comply with building code and setback requirements.
- Completed Structural Permit Application
- Two complete sets of construction plans (foundation plan, floor plans, cross-sections, elevations, wall bracing/lateral details, framing plans)
- Scaled site/plot plan showing setbacks, structure footprint, utilities, drainage, and easements
- Energy-code compliance documentation
- Local land-use approval (planning/zoning clearance)
- Sanitation approval (Environmental Health septic approval or municipal sewer clearance)
- Engineered plans/calculations (stamped by Oregon-licensed PE or architect) for retaining walls over 4 ft, non-prescriptive lateral systems, and special conditions
- Building code
- 2023 Oregon Residential Specialty Code (ORSC) mandatory as of April 1, 2024; 2025 Oregon Structural Specialty Code (OSSC) mandatory April 1, 2026; 2025 Oregon Energy-Efficiency Specialty Code (OEESC) mandatory July 1, 2025.
- Owner-builder
- Owner-builders may perform work on their own property under narrow exemptions defined by Oregon statute. Limited exemptions apply to electrical, plumbing, and mechanical work.
- Contractor requirements
- Contractors must hold a valid Oregon Construction Contractors Board (CCB) license. Electrical and plumbing contractors need dual licensing (CCB + Oregon BCD specialty license). Manufactured dwelling installers need CCB + BCD MDI license.
