When a permit is required
Permit triggers and exempt work for Marshall
Marshall requires a zoning permit before property use is substantially changed or buildings or other substantial structures are constructed, erected, moved, or substantially altered. Madison County requires a building permit for all new building construction, alteration, or renovation.
- Exempt Street construction or repair (town zoning exempt)
- Exempt Utility lines, wires, and pipes in a public right-of-way (town zoning exempt)
- Exempt Signs specifically exempted in Chapter 6 of the Marshall UDO (town zoning exempt)
- Exempt Mailboxes, newspaper boxes, walls, birdhouses, flag poles, pump covers, and doghouses (town zoning exempt)
- Exempt Interior alterations and renovations that do not alter the footprint, elevation, height, or use of an otherwise conforming structure (town zoning exempt)
- Exempt Qualifying small detached accessory buildings under 144 square feet (county building permit exempt per NC G.S. 160D-1110)
- Exempt Qualifying nonstructural residential repairs under $20,000 (county building permit exempt per NC G.S. 160D-1110)
- Exempt Qualifying replacement water heaters in one- and two-family dwellings (county building permit exempt per NC G.S. 160D-1110)
Note: Town zoning exemptions do not exempt work from county building permit requirements where applicable. General repairs are excluded from county building permits unless you are adding, changing, or altering what already exists.

- Permit validity
- Marshall zoning approval expires if the authorized use has not commenced or less than 10 percent of total construction cost has not been completed within 6 months. If work begins and is discontinued for 6 months, the permit expires. Extensions of up to 6 months may be granted. Madison County building permit expires if work does not commence and receive an inspection within 6 months, and there can be no more than 1 year between inspections.
- Owner-builder
- Madison County posts the NC Owner Exemption Affidavit. The owner claiming exemption must personally superintend the work, be on site regularly, be present for required inspections unless sealed architectural plans were used, and occupy the building for 12 months after completion without offering it for rent, lease, or sale during that period.
- Contractor requirements
- North Carolina requires a licensed general contractor for projects costing $40,000 or more. Electrical, plumbing, and mechanical work must be performed by properly licensed contractors where state law requires.

- 01 Confirm the project needs a Marshall zoning permit by reviewing the Town's Unified Development Ordinance (zoning permits required before property use changes or buildings are constructed, moved, or substantially altered).
- 02 Submit a complete Marshall zoning permit application to the Zoning Administrator with the required fee and supporting documents (for single-family residential: plot plan showing lot dimensions, adjacent rights-of-way, building locations, parking and driveway layout, impervious area, and front elevation).
- 03 If the project is non-residential or triggers site plan review under Chapter 12, submit a site plan and complete any required site plan or conditional use review before zoning permit issuance.
- 04 Complete the Madison County Property Improvement Checklist, which includes a separate Town Planning signoff line for projects in town limits.
- 05 Submit the completed Madison County permit forms and plans to the Madison County Inspection Department. Email completed forms to [email protected] or deliver in person.
- 06 Pay applicable fees to Madison County through online payment or in-person payment at the inspections office.
- 07 Schedule inspections with Madison County by calling the day before by 3:00 PM.
- 08 After all county inspections are complete, request final zoning certification from Marshall's Zoning Administrator, either coincident with the final building inspection or within 10 days of completion.
