When a permit is required
Permit triggers and exempt work for Mars Hill
Mars Hill requires a zoning permit from the Zoning Administrator before any regulated building, sign, or other structure may be erected, moved, added to, or structurally altered. Madison County requires a building permit for all new construction, alteration, or renovation.

- Permit validity
- Mars Hill zoning permits expire if the authorized work has not begun within 6 months from issuance. After work begins, progress must be apparent at least every 12 months or the permit expires. Approved site plans separately become void if no significant work is done within 12 months unless extended once for 1 year. Madison County building permit expires if work does not commence and receive an inspection within 6 months, and there can be no more than 1 year between inspections.
- Owner-builder
- Madison County posts the NC Owner Exemption Affidavit. The owner claiming exemption must personally superintend the work, be on site regularly, be present for required inspections unless sealed architectural plans were used, and occupy the building for 12 months after completion without offering it for rent, lease, or sale during that period.
- Contractor requirements
- North Carolina requires a licensed general contractor for projects costing $40,000 or more. Electrical, plumbing, and mechanical work must be performed by properly licensed contractors where state law requires.
Application process

- 01 Submit the Mars Hill zoning permit application to Town Hall. The application requests applicant information, location, zoning district, project type, use, estimated cost, and contractor information.
- 02 Include a plot plan or site plan drawn to scale showing lot dimensions, building dimensions and location, existing and proposed uses, number of families or units, existing conditions, and other information needed to determine conformance.
- 03 If the project triggers site plan review under Article VI (for listed multi-family and nonresidential development categories), complete that review first. Approved site plans are valid for 12 months unless extended.
- 04 Complete the Madison County Property Improvement Checklist. The county checklist includes a Town Planning signoff field before the county building inspection step.
- 05 Complete all Madison County permit forms and prepare construction plans.
- 06 Email completed Madison County forms and plans to [email protected] or deliver in person to the Madison County Inspection Department.
- 07 Pay applicable fees to Madison County through online payment or in-person payment.
- 08 Schedule inspections with Madison County by calling the day before by 3:00 PM.
- 09 After all county inspections are complete, request final zoning certification from the Mars Hill Zoning Administrator after the work is completed.
