Village of Milan

Any construction, structural alteration, change of use, or development activity within Milan requires notification to and approval from the Village Code Enforcement/Planning and Zoning Office. State CID building permits are required for all structural construction (new buildings, additions, alterations). Village-level permits or approvals include: change of zoning or variance, home occupation permits, outdoor advertising permits, mobile home/manufactured housing placement, and utility turn-on permits.

Note: Standard NM statewide exemptions from 14.5.2.9 NMAC apply to CID-issued permits. The Village maintains zoning and land use regulations distinct from unincorporated Cibola County (which has no zoning). Home occupation permits, outdoor advertising permits, and zoning variances must be obtained from the Village before or alongside building permit applications.

Building code

NM statewide codes (2021 IRC/NMRC, 2021 IBC/NMCBC, 2020 NEC) enforced through the state CID. The Village maintains its own Code of Ordinances (updated 2024) governing land use, zoning, signs, and other local standards.

Permit validity

Not confirmed from Village website. NM CID standard 180-day rule applies to CID-issued permits. Confirm Village-level permit validity with the office at (505) 290-4605.

Owner-builder

NM 14.5.2.18 NMAC applies to CID permits. Confirm any additional local restrictions with the Village office.

Contractor requirements

All contractors must hold a valid NM CID license. GB-98 or GB-2 for general building; separate trade licenses for electrical, plumbing, and mechanical.

   Contact the Zoning/Code Enforcement Officer at (505) 290-4605 or zoning@villageofmilan.com before beginning any construction or development in Milan. Confirm whether your project requires: (a) a local Village permit/approval, (b) a state CID building permit, or (c) both.

   For projects requiring Village Planning and Zoning review: Obtain the applicable application form from the Village website or office. Prepare a site plan and all required documentation. Submit application and fee to the Village prior to the Planning and Zoning Board meeting (1st Wednesday of each month). Submit early enough for the board agenda -- contact the office for submission cutoff deadline.

   Attend the P&Z Board meeting; receive approval or conditions.

   Pay applicable fees to the Village and/or CID as applicable.

   Receive issued permits; post permit on job site.

   Receive final approval or Certificate of Occupancy.

Typical processing time: Not formally published. P&Z Board meets monthly; allow at least 30 days for board review items. CID review time: allow 2--4 weeks. Contact both offices early for current estimates.
