When a permit is required
Permit triggers and exempt work for Montclair
Building permit required for new construction, additions, structural alterations, plumbing, electrical, mechanical work, demolition, and work described in NJAC 5:23-2.14.
- Exempt Refer to NJAC 5:23-2.14 for exempt work categories. Generally, ordinary maintenance and cosmetic work may be exempt.

- Completed NJ DCA Construction Permit Application with subcode sections
- Single family: 2 sets of sketches/drawings/plans
- Multifamily/Commercial: 3 sets of sealed plans
- Plans must be sealed by NJ-licensed professional for multifamily/commercial
- Building code
- NJ Uniform Construction Code (UCC) based on International Building Code (IBC) with NJ-specific amendments
- Permit validity
- NJ UCC permits valid for 12 months from last inspection; work must begin within 12 months of permit issuance.
- Contractor requirements
- All contractors must register with the NJ Division of Consumer Affairs and hold valid licenses.
Application process
Typical processing: 20 business days for approval or denial decision; payments accepted 8:30 a.m. to 2:30 p.m. only.
- 01 Complete Construction Permit Application with all applicable subcode sections.
- 02 Submit required documentation: Single family (2 sets of sketches/drawings/plans), Multifamily/Commercial (3 sets of sealed plans).
- 03 Hand-deliver complete application to Building Department.
- 04 Department has 20 business days to approve or deny.
- 05 Applicant receives phone call when permit approved.
- 06 Pay for permit (8:30 a.m. - 2:30 p.m. only).
- 07 Receive placard to post visibly from street.
- 08 Keep approved plans on site at all times.
