When a permit is required
Permit triggers and exempt work for Sutter County
Section 105.1 of the California Building Code requires a permit before constructing, altering, repairing, moving, demolishing, or changing occupancy of regulated structures and systems.
- Exempt One-story detached accessory structures such as sheds, playhouses, and shade structures that are 120 square feet or less, subject to setbacks.
- Exempt Fences not over 7 feet tall.
- Exempt Retaining walls not over 4 feet tall.
- Exempt Ground-level water tanks not exceeding 5,000 gallons.
- Exempt Sidewalks and driveways not more than 30 inches above grade and not part of an accessible route.
- Exempt Painting, flooring, cabinet work, and similar finish work.
- Exempt Above-ground pools under 5,000 gallons and not more than 24 inches deep.
- Exempt Agricultural shade cloth structures.
- Exempt Window awnings projecting less than 54 inches.
- Exempt Replacing light switches, light fixtures, and plumbing fixtures.
- Exempt Window glass replacement only.
- Exempt Decks 200 square feet or less, unattached, and not more than 30 inches above grade.
Note: Some exempt items may still require planning review, grading, setback, or utility approvals depending on project context. Any work that otherwise falls under California Building Code definitions should be confirmed with the department before starting.

- California Building Code, California Electrical Code, California Plumbing Code, California Mechanical Code, and other codes adopted by Sutter County and the State.
- Permit validity
- Permit expires after 180 days per the permit application form.
- Owner-builder
- The county requires owner-builder declaration and license-exemption declaration language in the permit package. Owner-builders are also warned that owner-built structures may not be legally sold within one year unless constructed through licensed contractors, subject to stated exceptions.
- Contractor requirements
- Permit applicants must be a California licensed contractor, authorized agent, or property owner using the stated owner exemption. Work without a permit can trigger a 1.5x fee penalty and referral to the Contractors State Licensing Board.

Application process
Application → plan check → issuance → inspection → final
- 01 Confirm the project is in unincorporated Sutter County and not inside Yuba City or Live Oak.
- 02 Prepare a Building Permit Application and required supporting materials and checklists.
- 03 Submit through eTRAKiT online, by hand at 1130 Civic Center Blvd, or by mail to the same address.
- 04 Pay required fees and wait for the official building permit to be issued.
- 05 Schedule inspections after permit issuance.
- 06 Complete required inspections and obtain final inspection approval.
