When a permit is required
Permit triggers and exempt work for Benicia
Most new construction, additions, alterations, residential remodeling, and work affecting electrical, mechanical, or plumbing systems require permits unless specifically exempt.
- Exempt One-story detached accessory structures without plumbing, electrical, or heating and up to 120 square feet
- Exempt Fences up to 7 feet high, except masonry fences over 3 feet may require review
- Exempt Retaining walls up to 4 feet, subject to surcharge and impoundment exceptions
- Exempt Water tanks supported on grade with capacity up to 5,000 gallons within code ratio limits
- Exempt Sidewalks, driveways, decks, and platforms under 30 inches above grade when non-egress constraints are met
- Exempt Single-family decks up to 200 square feet, up to 30 inches above grade, not attached to the dwelling, and not serving the required exit
- Exempt Cosmetic finish work such as painting, papering, flooring, cabinets, and trim, plus some minor plumbing and electrical work under code thresholds
- Exempt Prefabricated accessory pools under 24 inches deep and other listed code exceptions
Note: Permit exemptions do not remove other required approvals from planning, zoning, fire, environmental, right-of-way, utility, BCDC, or other agencies and departments.

- Permit validity
- Applications have a 30-day completeness timeline and may be deemed abandoned if not issued within 180 days unless an extension is approved. Mechanical and plumbing stand-alone permits require final inspection within 180 days; other building permits require inspection within 365 days. Commercial permits are listed at 12 months for $0-$100,000 valuation, 18 months for $100,000-$500,000, and 24 months for over $500,000.
- Owner-builder
- Owner-builder filing is allowed only for principal residential owner projects and is not available for commercial permits. Owner-builders must sign the required notice acknowledging responsibility and financial risk.
- Contractor requirements
- Contractors must provide contractor or HIC information, and the city directs applicants to contractor declaration forms and CSLB license checks.

- 02 If required, complete the pre-application through the Permit Center and pay the pre-application fee.

- 05 Building Safety reviews plans and collects the initial plan check fee, which covers the first review and first recheck.
