When a permit is required
Permit triggers and exempt work for Atherton
- Most building-related work on private property requires permit and separate planning/building applications by structure; separate permits are required for detached structures, demolition, grading/drainage, photovoltaic systems, landscape screening, and similar items. - Structures above 6 inches above grade generally need review; some small structures are specifically exempt (see Exempt Work). - Required documents at permit submittal: - Signed Building Permit Application form, and signed construction documents/plans (design professional signatures required on plans, studies, calculations). - Owner/builder disclosure when owner-builder is used; signed and returned before permit issuance. - Contractor information and licenses, plus worker compensation insurance data. - Required agency approvals and utility/impact notices where applicable (e.g., fire district, CalWater, school fees, BAAQMD demolition letter).
- Exempt - One-story detached tool/storage sheds up to 120 sf (may still require other approvals). - Fences (with height/location limits). - Small retaining walls, certain small tanks, sidewalks/driveways within thresholds. - Decks not exceeding 200 sf and limited height conditions. - Limited electrical/ mechanical/ plumbing minor repair categories and simple finish work. - Other items listed in Town’s "Work Exempt from Building Permit Requirements" handout.
Note: - Exempt from building permit does not mean exempt from Planning/Public Works or other agencies. - Many exempt-style jobs can still trigger planning, right-of-way, tree, or utility reviews. - Any permit requirements may still apply in right-of-way, encroachment, or heritage-tree situations.
