When a permit is required
Permit triggers and exempt work for Elk Grove
A permit is required before constructing, enlarging, altering, repairing, moving, demolishing, or changing occupancy of a building or structure, or installing, enlarging, altering, repairing, removing, or replacing regulated electrical, gas, mechanical, or plumbing systems. Emergency repairs still require application by the next working business day.
- Exempt One-story detached accessory structures such as tool sheds or playhouses not over 120 square feet
- Exempt Fences not over 7 feet high
- Exempt Retaining walls not over 4 feet high unless supporting surcharge or impounding specified liquids
- Exempt Ground-supported water tanks not over 5,000 gallons and meeting stated height to width ratio limits
- Exempt Sidewalks and driveways not more than 30 inches above adjacent grade, not over a basement or story below, and not part of an accessible route
- Exempt Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
- Exempt Certain shallow above-ground prefabricated pools accessory to Group R-3 occupancy
- Exempt Certain window awnings, playground equipment, and nonfixed movable fixtures under stated limits
- Exempt Minor electrical repair work, portable equipment connections, and temporary testing systems
- Exempt Portable heating, ventilation, cooling, and similar limited gas or mechanical items listed by the City
- Exempt Minor plumbing leak repairs and stoppage clearing that do not require replacement or rearrangement of concealed piping, valves, or fixtures

- Building code
- As of January 1, 2026, plan review applications submitted after December 31, 2025 must comply with the 2025 California code cycle, including the 2025 California Building Code and 2025 California Residential Code and related state codes.
- Permit validity
- Building permit applications are deemed abandoned 180 days after filing if not acted on. The City extension form states building permit applications may receive up to two 90-day extensions, and issued permits may receive up to two 180-day extensions on a case-by-case basis.
- Owner-builder
- Owner-builders must sign the statutory declaration and complete the City owner-builder notice and acknowledgment process before permit issuance. The owner may perform the work, use their own employees, or contract exclusively with licensed contractors, but assumes responsibility and potential liability as owner-builder.
- Contractor requirements
- Permit applicants must either provide a valid California contractor license or claim a lawful exemption. Licensed contractors must declare their license is in full force and effect and provide workers compensation information unless exempt.

Typical processing: Minor permits typically take 24 to 48 hours for processing and notification after submittal. Some plan review projects have longer stated timelines depending on project type, such as at least 10 business days for the first ADU plan review and 5 business days for subsequent reviews.

- 04 City staff performs a completeness and internal review.
- 05 For accepted applications, pay fees and download the issued permit and approved documents from the portal.
- 06 Schedule inspections online or by phone and obtain final approval before occupancy or use as applicable.
