When a permit is required
Permit triggers and exempt work for Kenai Peninsula Borough
No structural building permit is required in the unincorporated KPB rural district. Floodplain permits are required for any man-made development (structures, fill, dredging, driveways, additions, fishing platforms, etc.) within FEMA-mapped floodplains. Riparian permits required for projects within rivers or within 50 feet of Ordinary High Water on Habitat Protection District streams.

- The KPB has NOT adopted a residential or commercial building code for the unincorporated rural district. No locally enforced building code in unincorporated KPB. State Fire Marshal codes apply to commercial and multi-family buildings.

Application process
Typical processing: Floodplain and riparian permits generally take 30 days to process; Conditional Use Permits may take longer.
- 01 Determine whether the project is in a mapped FEMA floodplain (contact River Center or check FEMA flood maps).
- 02 Determine whether the project is within 50 feet of Ordinary High Water of a stream covered by the KPB Habitat Protection District.
- 03 If in a floodplain: complete a Floodplain Development Permit application and submit to the River Center, 514 Funny River Road, Soldotna, AK 99669.
- 04 If within the Habitat Protection District riparian setback: obtain a River Center Multi-Agency Permit before beginning any work.
- 05 For land use, road right-of-way, or utility easement work on borough lands: obtain the applicable land use permit from the Land Management Division.
- 06 For subdivision/platting: submit a plat application to the Platting Division.
- 07 No structural building permit is required by the borough for construction in the unincorporated rural district.
