Application Process

  1. Confirm zoning and planning requirements first. Aliso Viejo Planning Services states applicants must discuss the project with Planning and obtain Planning approval before submitting plans to Building; this starts with the Zoning Compliance Application (PS-240). For larger residential additions of 500 square feet or more, the city's residential checklist says a Site Development Permit must be approved before Building submittal.
  2. Prepare the permit package. Typical city documents include the Building and Grading Permit Application, project plans, plot/site plan, structural calculations if applicable, energy compliance forms, and the applicable residential or tenant-improvement checklist. Owner-builders must also complete the city Owner-Builder Responsibility form before permit issuance.
  3. Submit through the CSS portal, register for an account, and upload plans/documents. The city states applicants may submit permit applications, make payments, check permit status, and retrieve approved permits online.
  4. Respond to plan-check comments if the city requests corrections or missing information.
  5. Pay issuance fees and obtain the issued permit.
  6. Schedule inspections in the CSS portal. Inspections must be requested by permit type, and finals may require outside-agency or interdepartmental clearances depending on the project.

Typical processing time: The city publishes a 10 calendar day initial review timeline and 5 calendar day resubmittal review timeline for its AB 2234 post-entitlement permit process. The city does not appear to publish a single general turnaround for every permit class.

General Requirements

Aliso Viejo Municipal Code Chapter 13.02 makes it unlawful to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy, or maintain a building or structure contrary to the adopted building regulations. In practice, permits are required unless the work falls within adopted code exemptions.

Permit validity
The city amends CBC Section 105.5 so a permit becomes invalid if work does not commence within 12 months after issuance, or if work is suspended or abandoned for 180 days after commencement. The Building Official may grant written extensions of up to 180 days each for justifiable cause.
Building code
Aliso Viejo Municipal Code Section 13.02.010 adopts the 2025 California Building Code, 2025 California Residential Code, 2025 California Electrical Code, 2025 California Mechanical Code, 2025 California Plumbing Code, 2025 California Green Building Standards Code, 2025 California Energy Code, California Administrative Code, California Referenced Standards Code, California Existing Building Code, 2024 International Property Maintenance Code, California Fire Code, and California Wildland-Urban Interface Code, with local amendments.
Owner-builder
The city requires a signed Owner-Builder Responsibility form before permit issuance, warns that owner-builders are held to licensed-contractor code standards, and requires signature verification such as ID, notarization, or equivalent. The form also warns of employer, workers' compensation, resale, and liability risks.
Contractor requirements
The city permit application requires the applicant to identify whether they are a California licensed contractor, the property owner, or an authorized agent. The owner-builder materials state contractors are required by law to be licensed and bonded in California and to list their license numbers on permits and contracts.

Fees

Minimum permit fee
For valuation-based building permits, the FY 2025-26 schedule shows total building fees of $67.12 for projects valued from $0 to $1,000.00, consisting of a $25.84 permit fee, $16.80 plan check fee, and $24.48 permit issuance fee.
Plan check fee
Separate, valuation-based plan check fee listed on the city fee schedule; example $16.80 for $0 to $1,000 valuation.
Permit fee formula
Building permit fees are generally valuation-based. The city fee schedule also includes trade permit itemized fees, miscellaneous flat fees, and square-foot valuation tables by occupancy/type. For valuations over $1,000,000, the schedule states the plan check fee equals 65% of the building permit fee.
Reinspection fee
The fee schedule lists a Building Reinspection fee of $207.42. The municipal code and fee schedule also state work started without the required permit may result in an assessment including double the required permit fees.
Payment note
The city states applicants may make payments online through the CSS portal. Beginning April 1, 2024, hard copies are no longer accepted for online permitting intake.

Work That Does NOT Require a Permit

  • Detached accessory structures not exceeding 120 square feet.
  • Fences not over 7 feet high.
  • Retaining walls under 4 feet in height, unless supporting surcharge or retaining certain liquids.
  • Water tanks on grade if capacity does not exceed 5,000 gallons and the height-to-diameter ratio does not exceed 2:1.
  • Sidewalks and driveways not more than 30 inches above adjacent grade and not over a basement or story below.
  • Finish work such as painting, papering, tiling, carpeting, cabinets, counter tops, and similar finish work.
  • Prefabricated swimming pools that are less than 24 inches deep.
  • Swings and other playground equipment for detached one- and two-family dwellings.
  • Certain window awnings for Group R-3 and Group U occupancies.
  • Certain small detached decks meeting the code size/height/egress limits.

Important: This list reflects standard building-code permit exemptions incorporated through Aliso Viejo's adoption of the California codes; separate electrical, plumbing, mechanical, fire, grading, HOA, and zoning/planning approvals may still apply. The city specifically notes applicants must clear Planning before Building submittal, and local amendments can remove or narrow state-code exemptions in specific situations.
