Jaspector Terms of Service
1. Acceptance of Terms
Welcome to Jaspector! These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and DALANA LLC ("Jaspector," "we," "us," or "our"), governing your use of our AI-powered email-based property assistant service.
By subscribing to, accessing, or using Jaspector's services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
2. Service Description
2.1 Overview
Jaspector provides an AI-powered email-based advisory service designed to help homeowners navigate property maintenance, construction projects, and contractor selection. Our service includes:
- Email-based consultation with AI specialists
- Educational guidance on construction, grading, drainage, foundation, and roofing topics
- Contractor matching and referral services
- Optional premium services including contractor vetting, scope development, and contract review
2.2 AI-Powered Service Disclosure
IMPORTANT NOTICE: Jaspector's primary service interface consists of AI-powered agents. When you communicate with our team members via email, you are interacting with advanced artificial intelligence systems designed to provide helpful construction and property guidance. While our AI agents are trained on extensive construction knowledge and best practices, they are not human professionals and do not replace licensed contractors, engineers, or inspectors.
2.3 Subscription Plans
- Monthly Plan: $9/month — Core email advisory service
Pricing is subject to change with 30 days' notice to active subscribers.
3. Scope of Service and Limitations
3.1 Educational Guidance Only
CRITICAL DISCLAIMER: Jaspector provides educational information and general guidance only. Our service:
- Is NOT a substitute for professional engineering, architectural, or licensed contractor services
- Does NOT constitute professional advice specific to your property
- Does NOT include on-site inspections, measurements, or physical assessments
- Does NOT guarantee specific outcomes for your construction projects
- Does NOT create a professional-client relationship with licensed practitioners
3.2 No Professional Licensing
Jaspector and its AI agents are not licensed contractors, engineers, architects, or inspectors. Our guidance is based on general construction knowledge and best practices but cannot account for all site-specific conditions, local building codes, or unique property characteristics.
3.3 Requirement for Professional Consultation
You acknowledge and agree that:
- You must consult with licensed professionals for all construction work
- You must obtain proper permits as required by local jurisdictions
- You must verify all information provided by Jaspector independently
- You assume all responsibility for decisions made based on our guidance
4. Contractor Referral Services
4.1 Matching Service
Jaspector may connect you with contractors in our network based on your project needs and location. This matching service is provided for convenience only.
4.2 No Guarantees or Endorsements
IMPORTANT: Jaspector does NOT:
- Guarantee the quality, timeliness, or professionalism of referred contractors
- Conduct comprehensive background checks or performance audits
- Assume liability for contractor work, delays, disputes, or outcomes
- Endorse or vouch for any specific contractor
4.3 Customer Due Diligence
You are solely responsible for:
- Verifying contractor licenses through the California State License Board (CSLB) at www.cslb.ca.gov
- Checking references and past work
- Reviewing insurance and bonding
- Negotiating contracts and payment terms
- Obtaining multiple bids
- Making the final hiring decision
4.4 Contractor Relationships
Any contractual relationship formed between you and a referred contractor is entirely separate from your relationship with Jaspector. We are not a party to such agreements and bear no responsibility for disputes arising from them.
5. Subscription Terms
5.1 Billing
- Monthly subscriptions renew automatically on the anniversary of your signup date
- Payment is processed via Stripe
- You authorize us to charge your payment method on file
- All fees are in U.S. Dollars and are non-refundable except as specified in Section 6
5.2 Auto-Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
5.3 Price Changes
We may change subscription prices with 30 days' advance notice via email. Price changes apply to subsequent billing periods. If you do not agree to a price increase, you may cancel your subscription before the new rate takes effect.
5.4 Cancellation
You may cancel your subscription at any time by:
- Emailing support@jaspector.com
- Following cancellation instructions on our website
- Responding to any Jaspector email with cancellation request
Cancellation takes effect at the end of your current billing period. You will retain access to services through that date.
6. Refund Policy
6.1 30-Day Money-Back Guarantee
First-time subscribers may request a full refund within 30 days of initial signup if not satisfied with the service. To request a refund, email support@jaspector.com with "Refund Request" in the subject line.
6.2 Premium Add-On Services
Premium services (vetting, scope development, contract review) are refundable within 7 days of purchase if services have not yet been delivered. Once delivered, these services are non-refundable.
6.3 No Pro-Rated Refunds
We do not offer pro-rated refunds for partial months of service except as required by law.
7. Intellectual Property
7.1 Jaspector Ownership
All content, software, designs, logos, and materials provided through Jaspector's service are owned by DALANA LLC or our licensors. You may not:
- Reproduce, distribute, or create derivative works without permission
- Use our service to train competing AI systems
- Reverse engineer our AI systems or software
7.2 Customer Content
You retain ownership of information, photos, and project details you share with Jaspector. By using our service, you grant us a limited license to use this information to provide services, improve our AI systems, and generate anonymized training data.
7.3 Course Content (if applicable)
Any educational courses purchased from Jaspector are licensed for personal use only. You may not resell, redistribute, or publicly share course materials.
8. Privacy and Data Use
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Jaspector, you consent to our data practices as described in the Privacy Policy.

- Email communications are processed by AI systems (Claude API)
- Project details may be shared with matched contractors
- We comply with the California Consumer Privacy Act (CCPA)
- You have rights to access, delete, and opt-out of data sales
9. User Conduct and Prohibited Uses
You agree NOT to use Jaspector's service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malware, viruses, or harmful code
- Harass, threaten, or abuse our team or AI agents
- Attempt to circumvent security measures
- Use the service for fraudulent purposes
- Impersonate others
- Spam or send unsolicited commercial messages
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JASPECTOR'S SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Accuracy: We do not warrant that information provided is accurate, complete, or current
- Reliability: We do not guarantee uninterrupted or error-free service
- Results: We do not warrant specific outcomes from following our guidance
- Contractor Quality: We make no warranties regarding referred contractors
California customers have certain rights that cannot be waived, including warranties implied by law. This disclaimer does not affect those statutory rights.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW:
11.1 No Consequential Damages
Jaspector shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Property damage from construction projects
- Financial losses from contractor disputes
- Project delays or cost overruns
- Loss of profits or business opportunities
11.2 Liability Cap
Our total liability to you for any claim arising from these Terms or use of our service shall not exceed the amount you paid to Jaspector in the 12 months preceding the claim, or $100, whichever is greater.
11.3 California Exceptions
Some states do not allow limitations on implied warranties or exclusion of certain damages. If California law prohibits any portion of this limitation, our liability will be limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless DALANA LLC, its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of our service
- Your violation of these Terms
- Your violation of any third-party rights
- Disputes with contractors you hire through our referrals
- Construction projects undertaken based on our guidance
13. Dispute Resolution
13.1 Informal Resolution
Before filing any legal claim, you agree to contact us at support@jaspector.com to attempt to resolve the dispute informally. We will attempt to resolve the issue within 30 days.
13.2 Binding Arbitration
If informal resolution fails, any dispute arising from these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration Terms:
- Location: Castro Valley, California or via video conference
- Governing Law: California law
- Arbitrator's decision is final and binding
- Each party bears its own costs unless the arbitrator awards fees to the prevailing party
13.3 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.
13.4 Small Claims Exception
Either party may bring an individual action in small claims court as an alternative to arbitration.
13.5 Injunctive Relief
Either party may seek injunctive or equitable relief in court to protect intellectual property rights.
14. Modifications to Terms
We may modify these Terms at any time by:
- Posting updated Terms on our website
- Sending notice via email to your registered address
- Noting the "Last Updated" date at the top of this document
Continued use of Jaspector after changes take effect constitutes acceptance of the new Terms. If you do not agree to changes, you must cancel your subscription.
15. Termination
15.1 Termination by You
You may terminate your subscription at any time as described in Section 5.4.
15.2 Termination by Jaspector
We may suspend or terminate your access immediately if you:
- Violate these Terms
- Provide false information
- Engage in fraudulent activity
- Abuse our service or team members
15.3 Effect of Termination
Upon termination:
- Your access to the service ends immediately (or at period end for voluntary cancellations)
- Outstanding fees remain due
- Sections 7, 10, 11, 12, and 13 survive termination
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jaspector regarding our service.
16.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
16.3 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
16.4 Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations to any successor entity.
16.5 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
16.6 Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or internet service failures.

16.8 Notice Requirements

17. California-Specific Consumer Rights
California residents have the right to:

- Request deletion of personal information
- Opt-out of "sale" of personal information (we do not sell data)
- Non-discrimination for exercising privacy rights

YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT:
- Jaspector provides AI-powered educational guidance, not professional services
- You must consult licensed professionals for all construction work
- Jaspector does not guarantee contractor quality or project outcomes
- You waive the right to participate in class actions
- Disputes will be resolved through binding arbitration in California
If you do not agree to these Terms, do not use Jaspector's service.
