How to apply for a building permit in Nevada City, California. Permit authority, application steps, fees, and inspection requirements.
Permit Authority
For properties inside Nevada City limits, applicants first submit the required city planning or architectural review application to Nevada City. If the project also requires a building permit, the applicant then submits the city-approved plans to the Nevada County Building Department, which performs building plan review, permit issuance, and inspections for the City by contract.

Application Process
- Confirm the Nevada City entitlement path first and choose the correct planning form and supporting documents.
- Submit the required Nevada City planning or architectural review application in person at City Hall or by email to the City Planner.
- Pay the Nevada City planning fee. The City says the project will not be reviewed until the fee is paid.
- After City approval, submit the city-approved plans to the Nevada County Building Department if the project requires a building permit.
- Provide the building submittal package and pay plan check fees. County materials call for the permit application plus project documents such as plans, site plan, engineering or truss calculations where applicable.
- Respond to corrections and obtain outside clearances as needed.
- Receive the permit, keep the approved plans on site, and schedule required inspections through the county inspection system as construction progresses.
Typical processing time: Nevada City does not publish a standard planning review timeline on the pages reviewed. Nevada County publishes an Over-the-Counter Wednesday process for qualifying minor projects by appointment; otherwise, no universal countywide turnaround is posted on the main permit pages reviewed.
General Requirements
Applicants within city limits must first obtain City approval, then submit city-approved plans to Nevada County if the project requires a building permit. County materials require a permit before constructing, enlarging, altering, repairing, moving, demolishing, or changing occupancy of a building or structure, and before installing or altering regulated electrical, gas, mechanical, or plumbing systems.

- Permit validity
- Nevada County materials state the permit expires 12 months from issuance or 12 months from the last passing inspection. The county handbook also says permits are active for one year from issuance and may be eligible for a one-year extension for justifiable cause if requested before expiration. The county application form separately states permitted work must be completed within 2 years of issuance.
- Building code
- All construction projects submitted on or after January 1, 2026 must comply with the 2025 California Building Standards Code, including current Energy Codes, plus Nevada County local amendments effective January 1, 2026. Nevada City relies on Nevada County for building code enforcement under the City contract arrangement.
- Owner-builder
- Nevada County application materials include an Owner-Builder Declaration and require the applicant to select the applicable owner-builder basis under penalty of perjury.
- Contractor requirements
- Nevada County application materials require the applicant to affirm California contractor license status when acting as contractor and include workers' compensation declarations required by California law.
Fees
- Minimum permit fee
- Nevada City planning fees start at $120 for minor like-for-like architectural review and $120 for certain change-of-occupancy or sign-review items. On the county side, FY 25-26 building fees show $92.74 for OTC permit processing and $185.48 for non-OTC permit processing, both in addition to applicable inspection, plan review, state, and other local charges.
- Plan check fee
- Nevada City charges separate planning review fees where applicable, such as $120 for Plan Check (other), $240 for generator plan check, and percentage-based grading plan check items. Nevada County plan review fees vary by occupancy and square footage; for example, code 221 for site-built residences is $975.62 plus $0.03 per square foot and includes one plan recheck.
- Permit fee formula
- Mixed. Nevada City uses flat fees or deposits by entitlement type. Nevada County uses a combination of administrative flat fees, hourly-rate fees, and use- or square-footage-based building inspection and plan review formulas.
- Reinspection fee
- Nevada County FY 25-26 fees list reinspection under code B114 at $185.48. Reinspection fees must be paid before another inspection will be scheduled.
- Penalty (no permit)
- Nevada City FY 25-26 fees include after-the-fact permit pricing at $230 plus staff time and management cost for permits without a listed fee, or 2x permit fee plus staff time and management cost for permits with a listed fee. The City also has a general late submission charge of $25 or 15%, whichever is higher, where no specific late charge is set.
- Payment note
- Nevada City planning fees may be paid in person at City Hall or online through the City Paystar payment portal. Nevada County also links online building payments through LexisNexis.
Fees change. Verify current amounts at the official fee schedule (effective July 1, 2025).
Work That Does NOT Require a Permit
- One-story detached accessory structures up to 120 square feet; Nevada County also notes one 200 square foot one-story detached accessory structure
- Fences not over 7 feet high
- Retaining walls not over 4 feet high unless supporting a surcharge
- Water tanks supported directly on grade if capacity does not exceed 5,000 gallons and the height-to-diameter or width ratio does not exceed 2:1
- Sidewalks and driveways
- Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
- Prefabricated swimming pools less than 24 inches deep
- Swings and other playground equipment
- Window awnings meeting the County dimensional and support limits
- Detached decks not over 200 square feet, not more than 30 inches above grade, not attached to a dwelling, and not serving the required exit door
- Minor electrical work such as listed cord-and-plug temporary decorative lighting, like-kind overcurrent device replacement, and low-voltage work under the County posted thresholds
- Minor gas, mechanical, and plumbing work listed on the County exemption page, including certain portable equipment, minor-part replacements, stopping leaks, and clearing stoppages where piping, valves, or fixtures are not replaced or rearranged
Important: Nevada County states that if a project is not on its exemption list, a permit is required. Exemptions do not remove the need to comply with code or other laws. Within Nevada City, separate city planning or architectural review may still be required even where the County building permit exemption list applies.

- Next-working-day inspections must be requested by 12:00 a.m. midnight. For cancellations, call by 8:00 a.m. on inspection day.
- Inspection hours
- Building Department public hours are Monday through Friday, 8:00 a.m. to 5:00 p.m. Nevada City is served in the western county inspection area, which operates Monday through Friday.
- Time windows
- Today's two-hour inspection window is posted online by 8:00 a.m. on inspection day.
Typical inspection sequence: The exact inspection sequence depends on permit type and approved plans. County examples include foundation and final for many simple permits; deck and final for reroofs; footing and final for fences over 7 feet; foundation and grout lifts for masonry retaining walls; forms, footing, and wall for concrete retaining walls; and final inspection for permit completion. Larger projects typically include foundation or under-slab stages, framing and rough trade stages, insulation or cover stages where applicable, and final.
