General Requirements

The Town states a building permit is required for all construction, demolition, repair, reconstruction, rehabilitation, alteration, addition, or other improvement not specifically exempted. The Town also notes many minor improvements require permits, and a Certificate of Occupancy may be required for a change in occupancy even with no construction. Permit validity
San Anselmo adopts the 2022 California Building and Residential Codes by reference. Under those adopted codes, permit applications are generally abandoned after 180 days if not pursued, and issued permits generally become invalid if work does not start within 180 days or is suspended/abandoned for 180 days, unless extended in writing by the building official. Building code

Owner-builder
The Town requires its Owner/Builder Declaration Form when the permit is issued in the property owner's name or an authorized agent applies on the owner's behalf. The form states the owner is responsible and liable for the construction, must disclose whether work will be self-performed or done through licensed contractors, and may need signature verification at issuance. The effective fee schedule dated September 23, 2025 uses a valuation table. For current building valuation rates, projects valued at $1-$3,999 carry a base building permit fee of $149.11. Separate trade permits not tied to other work are generally $168 minimum for plumbing, electrical, or mechanical permits. Plan check fee
General building permit plan check is 65% of the permit fee; additional plan checks beyond two submittals may be charged at staff or consultant rates. Trade plan checks are also percentage-based. Penalty (no permit)
The permit-fees page warns repeated inspections may require additional fees. The fee schedule lists stop-work and after-the-fact penalties of up to 5 times the permit fee, with a $500 minimum, plus $190 for an extension and reinstatement at 50% of the building permit fee. Work That Does NOT Require a Permit

  • One-story detached accessory buildings used as sheds, playhouses, or similar uses when not over 120 square feet or 8 feet in height; accessory structures still count toward lot coverage/floor area, and utility connections trigger permit requirements
  • Fences 7 feet or less in height
  • Retaining walls under 4 feet measured from bottom of footing to top of wall when supporting only level dirt for about 4 feet behind and 4 feet in front
  • Walkways or driveways under 150 square feet placed on grade
  • Detached decks not exceeding 200 square feet, not more than 30 inches above grade, not attached to a structure, and not serving an exit door
  • Painting, papering, and similar finish work unless part of a larger permitted project
  • Window awnings on single-family residences or garages that project no more than 54 inches
  • Stopping leaks or clearing stoppages in plumbing systems when valves, pipes, or fixtures are not replaced
  • Replacement of electrical receptacles, switches, circuit breakers, or fixtures when wiring is not changed or moved
  • Non-fixed movable cases, racks, counters, and partitions in nonresidential facilities not over 5 feet 9 inches high

Important: Fences or structures within 20 feet of the front property line require a separate Public Works fence permit and may be limited to 3 feet in height. Walkway/driveway work over 150 square feet requires a flatwork permit, and over 500 square feet of impervious surface requires bioretention. Accessory structures over 120 square feet, over 8 feet high, or connected to utilities require permits, and zoning/planning constraints still apply even where a building permit is exempt.
