Permit Authority

The Building Division regulates building permits within the City of Eureka. Work in the public right-of-way is handled separately by the City Engineering Division through encroachment permits.

Application Process

  1. Create an OpenGov account and choose the correct permit type, such as over-the-counter, residential, commercial, demolition, or solar.
  2. Upload the application and supporting plans or documents through the City portal. For larger projects, use the City's published submittal checklists and document-format instructions.
  3. City staff reviews the submission for completeness and routes it for plan review. If the package is incomplete, staff requests missing items before routing.
  4. Pay permit fees after review through OpenGov for a fee, by calling Finance, or in person at City Hall.
  5. Once review is complete and fees are paid, the permit is issued by email.
  6. Schedule required inspections through OpenGov or the 24-hour inspection hotline.

Typical processing time: The City does not publish a general review-time estimate on its current building pages. Building permits using pre-approved ADU plans are reviewed within 30 days of a complete application.

General Requirements

Building permits are required for most construction, alteration, repair, demolition, grading, solar, tenant improvement, addition, new construction, and similar work unless the work falls under an exemption. Separate permits may be needed for work in the public right-of-way and for utility or sewer connections.

Permit validity
Under the adopted California administrative provisions, permit expiration was changed from 180 days to 12 months, with written extensions available unless the work is determined abandoned.
Building code
Eureka Municipal Code section 150.015 adopts the 2022 California Building Standards Code and related model codes.
Owner-builder
The City requires an owner-builder acknowledgment form and will not issue an owner-builder permit until the owner reads, initials, signs, and returns the form. The form states an owner-builder is the responsible party of record and may face employer and workers' compensation obligations.
Contractor requirements
Contractors are required by California law to be licensed and bonded and to list license numbers on permits and contracts. The Building Division also directs applicants to verify license status with CSLB.

Fees

Minimum permit fee
$142.33
Plan check fee
Hourly plan review fee is $100.00 for building permits. Grading plan review is not to exceed 65% of the grading permit fee.
Permit fee formula
Building permit fees are primarily valuation-based, with higher graduated rates above base tiers. Separate electrical, plumbing, mechanical, grading, demolition, solar, EV, and other fee lines also apply where relevant.
Reinspection fee
Building reinspection fee is $100.00. Code compliance or reinspection fee is $142.33.
Penalty (no permit)
Work-without-permit investigation fee equals the permit fee for a first violation in 12 months, doubles the permit fee for a second violation, and is nine times the permit fee for a third or subsequent violation.
Payment note
Payment can be made through OpenGov for a fee, by phone through Finance at 707-441-4120, or in person at the City Hall finance window.

Work That Does NOT Require a Permit

  • One-story detached accessory structures not over 120 square feet
  • Fences not over 7 feet high
  • Retaining walls not over 4 feet high unless supporting a surcharge
  • Water tanks on grade up to 5,000 gallons if they meet code ratios
  • Sidewalks and driveways
  • Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
  • Prefabricated swimming pools less than 24 inches deep
  • Swings and playground equipment
  • Window awnings meeting the City handout limits
  • Detached decks not exceeding 200 square feet, not more than 30 inches above grade, not attached to a dwelling, and not serving the required exit door
  • Listed temporary decorative lighting and other minor electrical repair items in the handout
  • Portable heating, cooking, and clothes-drying appliances and other minor gas, mechanical, or plumbing work listed in the handout

Important: Exemptions do not authorize work that violates any code, law, or ordinance. Emergency replacement or repair work still requires a permit application by the next working business day. Ordinary repairs lose exemption status if they involve structural removal, egress changes, or new or relocated plumbing, electrical, gas, sewer, or mechanical work affecting public health or safety.

How to Schedule

Inspection hours
Building Division phone hours are 8:00 AM to 12:00 PM and 1:00 PM to 5:00 PM. Appointments are available 9:00 AM to 12:00 PM and 1:00 PM to 4:00 PM.
Time windows
The City does not publish fixed inspection time windows. The assigned inspector contacts the applicant on the inspection day before arriving.

Typical inspection sequence: The City does not publish a universal sequence on the main Building Division page; inspections depend on project scope and permit type. Work must remain accessible for inspection until approved.
