When a permit is required
Permit triggers and exempt work for Rappahannock County
Under Virginia USBC Section 13VAC5-63-80, a permit is required before construction or demolition of a building or structure, for most structural, electrical, plumbing, mechanical, fuel-gas, fire-protection, and equipment-regulated work, for some changes of occupancy, for lot-line movements that reduce safety, and for asbestos disturbance during building construction or demolition.
- Exempt Low-voltage wiring and equipment in the exempt categories listed in 13VAC5-63-80(B)(1)
- Exempt One-story detached tool sheds, storage sheds, playhouses, and similar uses up to 256 square feet (if not Group F-1 or H occupancy)
- Exempt Detached prefabricated utility buildings up to 150 square feet
- Exempt Tents or air-supported structures up to 900 square feet with an occupant load of 50 or less
- Exempt Fences of any height, unless required for pedestrian safety or used as a swimming-pool barrier
- Exempt Concrete or masonry walls up to 6 feet above finished grade
- Exempt Retaining walls supporting less than 3 feet of unbalanced fill, subject to code limits
- Exempt Small swimming pools with a surface area not greater than 150 square feet and a depth under 24 inches
- Exempt Certain signs under USBC Appendix H
- Exempt Replacement of aboveground LP-gas containers of the same capacity in the same location by the serving gas supplier
- Exempt Flagpoles 30 feet or less
- Exempt Temporary ramps serving certain dwelling units where the entrance height is no more than 30 inches above grade
- Exempt Minor and ordinary work deemed by the building official not to adversely affect public health or safety
- Exempt Ordinary repairs under 13VAC5-63-80(B)(14), including certain same-size window and door replacements, fixture replacements without system alteration, certain residential switch and receptacle replacements, certain non-gas and non-oil appliance replacements, qualifying roof-covering and siding replacements, limited roof-deck replacement, floor finishes, cabinetry and trim, paint, wallpaper, and similar minor work
Note: Virginia USBC exemptions apply unless the building official requires a permit because of historic-district or special-flood-hazard conditions. Exempt from building permit does not mean exempt from zoning and planning requirements. Confirm with the Rappahannock County Building Office before proceeding.
- Completed county permit application form
- General description and location of the proposed work
- Construction documents or drawings as determined necessary by the building official
- Proof of contractor licensure (Virginia DPOR) or a written statement that the applicant is not subject to licensure
- Proof of any required local taxes or license fees
- Zoning permit materials, plat review forms, land-disturbance paperwork, VDH health review form, or erosion-and-sediment agreement forms as applicable to the project scope
- Building code
- Virginia Uniform Statewide Building Code (USBC), as administered locally by Rappahannock County. Current USBC chapter reflects amendments effective January 18, 2024. County zoning and floodplain rules are in Chapter 170 of the county code.
- Permit validity
- Under 13VAC5-63-80(H), an application is deemed abandoned six months after filing if not pursued in good faith or issued, unless extended by the building official. Contact the Building Office for post-issuance expiration rules.
- Owner-builder
- Virginia contractor licensing law exempts a person who performs or supervises construction, removal, repair, or improvement of no more than one primary residence owned by that person for their own use during any 24-month period. The exempt owner must still comply with all Virginia USBC requirements. Source: Va. Code § 54.1-1101.
- Contractor requirements

- 01 Determine which county office handles your project scope. Building permits start with the Building Office; zoning, subdivision, floodplain, and hearing-related approvals start with Planning and Zoning Administration. Many projects require coordination with both offices.
- 02 Contact the Building Office or Planning and Zoning Administration before submitting — the county expressly states that a request may require multiple forms depending on scope.
- 03 Complete the applicable county form set. Available forms include building permit, solar, trade (electrical/plumbing/mechanical), pool, demolition, farm structure affidavit, agreement in lieu of an erosion and sediment plan, land disturbing permit, zoning permit, special exception, variance, appeal, rezoning, PWSF, and subdivision plat review.
- 04 Assemble supporting materials: project description, location, construction documents or drawings as required by the building official, proof of contractor licensure or a written licensure exemption statement, and proof of any required local taxes or license fees. If sewage or well issues are involved, obtain and include the VDH Request for Health Department Review form.
- 05 Submit the complete application package to the county. Under Virginia USBC rules, applications may also be submitted by mail; electronic submission is permitted if accepted by the building official.
- 06 Pay the applicable county fees once staff confirms the submission package and fee basis.
- 07 After all applicable approvals and fee payment, the county issues the permit. The Building Office then conducts required inspections during construction.
