When a permit is required

Permit triggers and exempt work for Powhatan County

Permits are required under the 2021 Virginia Uniform Statewide Building Code before constructing, altering, demolishing, or moving a building or structure; for installation or alteration of regulated equipment or systems; for certain changes of occupancy; for certain lot-line changes affecting code compliance; and for asbestos disturbance during construction or demolition. Building code
2021 Virginia Uniform Statewide Building Code, effective January 18, 2024. Plan sets must identify the code year and code type.
Permit validity
Permits are subject to the Virginia Construction Code timing rules: application abandonment after 6 months if not diligently pursued, and permit revocation risk if work does not begin within 6 months after issuance or is suspended or abandoned for 6 months. Extensions are available via the county's permit-extension form, which requires the applicant to certify that work has not been suspended or abandoned for 6 months or more since issuance.
Owner-builder
Applicants without a valid Virginia contractor license must complete a notarized Affidavit of Exemption from Contractor Licensing. Exemption categories under Virginia law include a homeowner building or improving their own primary residence for personal use, certain immediate-family gift housing, certain lessee or agent situations, and contractors with total contract value not exceeding $1,000 where trade licensing thresholds are not triggered.
Contractor requirements
Powhatan requires copies of the contractor's Virginia state license in residential and commercial permit packages. Out-of-county contractors must obtain required local business licensing before grossing $25,000 in Powhatan County. Contractors must provide their State Board for Contractors registration number before a county business license may be issued. Virginia contractor licensing is administered by DPOR (Virginia Department of Professional and Occupational Regulation).

$75 reinspection fee after a second failed inspection or if work is not ready on the first inspection

Stop-work-order fee: $150. Working without a required permit: $150 or 35% of the applicable permit fee, whichever is greater.

Fees must be paid in person at submittal. Accepted payment methods: check, cash, credit card (2.75% surcharge), debit card (1.75% surcharge). American Express is not accepted. Refund requests retain $50 or 25% of the original fee, whichever is greater.

Separate inspection tracks apply for gas permits, pools, manufactured housing, commercial work, industrialized buildings, elevators, and special inspections (shrink-swell soil analysis, soil bearing, concrete strength, weld analysis, fastener tensioning, air balance). County-approved plans must be on site for all inspections. Initial erosion must be complete before framing inspection. Setback certification must be submitted before framing if required. Accessory structures do not receive a final inspection before the main dwelling final. Exterior lighting must comply with the county's dark-sky requirement before certificate-of-occupancy issuance.
