When a permit is required
Permit triggers and exempt work for Lancaster County
A building permit is required when constructing, enlarging, altering, repairing, or demolishing a building or structure; changing use in a way that triggers greater code requirements; installing or altering equipment regulated by the building code; or removing or disturbing asbestos during demolition, alteration, renovation, or additions. Permits are also required for trades, signs, tents, pools, bulkheads, piers, rip rap, groins, and after-the-fact work.
- Exempt Wiring and equipment operating below 50 volts, network powered broadband communications systems, and other qualifying low-voltage work, unless located in a plenum, penetrating rated or smoke-protected construction, or tied to specified life-safety systems
- Exempt Detached accessory structures such as tool sheds, storage sheds, or playhouses not exceeding 256 square feet (zoning approval is still required for accessory buildings; trade permits are still required if electrical, plumbing, or mechanical work is included)
- Exempt Detached prefabricated buildings for publicly regulated utility equipment not exceeding 256 square feet
- Exempt Tents or air-supported structures of 900 square feet or less with an occupant load of 50 or fewer
- Exempt Fences and privacy walls not part of a building or pool barrier that do not exceed 6 feet in height
- Exempt Retaining walls supporting less than 2 feet of unbalanced fill (subject to stated liquid and surcharge exceptions)
- Exempt Small swimming pools not over 150 square feet, under 5,000 gallons, and less than 24 inches deep
- Exempt Ordinary repairs as described in the permit-required pamphlet, including many same-kind replacements and interior finishes, subject to listed structural, egress, trade, health, and safety exclusions
- Exempt Signs qualifying under the sign exemption cross-reference in the county pamphlet
Note: Even where the county pamphlet lists a building-permit exemption, local zoning, floodplain, Chesapeake Bay, wetlands, and town zoning approvals can still apply. Confirm with the Lancaster County Building Office before proceeding.

- Building code
- Virginia Uniform Statewide Building Code; 2021 Virginia Residential Code and 2021 Virginia Construction Code. A countywide residential code modification effective February 5, 2026 applies to ceiling insulation values.
- Permit validity
- A permit becomes invalid if work is not commenced within 6 months of issuance, or if authorized work is suspended or abandoned for 6 months after commencement. Trade permits remain valid while the related building permit remains in effect.
- Owner-builder
- Lancaster's contractor statement form includes an Owner's Affidavit for owners performing the work themselves, citing Code of Virginia section 54.1-1111.
- Contractor requirements
- Lancaster requires a valid Virginia contractor's license number on the contractor statement form, citing Code of Virginia section 54.1-1111. Applicants must also furnish proof that any taxes or license fees required by a county, city, or town have been paid.
Application process
Typical processing: Minimum 3 business days for residential review. The Building Office FAQ states review varies by project complexity but can usually be completed within 1 to 3 working days.
- 01 Confirm whether the project needs only a building permit or also separate county land-use approvals. Lancaster reviews erosion and sediment control, stormwater, Chesapeake Bay Resource Protection Area encroachments, floodplain work, wetlands work, and subdivision utility permits separately. Projects inside the incorporated towns of Kilmarnock, Irvington, or White Stone also require an approved town zoning permit before the county can issue a building permit.
- 02 Download the correct county form set from the Building Office page. Lancaster posts residential, commercial, and demolition building permit applications, a supplemental information package, a permit-required pamphlet, deck guidelines, and special-inspection materials.
- 03 Assemble the supporting package. The current single-family checklist requires the completed permit form, septic and well documentation, construction plans, a scaled site plan, utility permit where applicable, erosion and stormwater agreements, WQIA and Bay Act site plan if encroaching in an RPA buffer, flood elevation certificate if applicable, deed support if ownership differs from tax records, and a copy of the approved town zoning permit when the site is inside one of the incorporated towns.
- 04 Submit the application to the Building Office by email to build@lancova.com, by fax, or by mail. Do not pay until county staff send a permit number and the amount due.
- 05 Pay the billed fee by mailed check or through Web Fee Pay online. The county charges a 2.45% convenience fee for online card transactions.
- 06 Receive permit issuance, post the permit and stamped plans on site, and install required erosion controls before starting work.
- 07 Schedule all required inspections by calling the county inspection line at 804-462-0241. Calls made before 2:30 p.m. are scheduled for the next business day. Emailed requests and messages left on other voicemail boxes are not accepted as inspection requests.
