When a permit is required
Permit triggers and exempt work for Isle of Wight County
A permit is required before constructing, enlarging, altering, repairing, or demolishing a building or structure; changing use when the new use triggers greater code requirements; installing or altering regulated equipment; disturbing asbestos-containing materials during covered work; installing or replacing decks; finishing attics, basements, or bonus rooms; installing pools more than 24 inches deep; replacing or installing water or sewer lines; installing new electrical equipment or wiring; installing gas-fired appliances; or placing fuel tanks. County zoning permits are separately required for many site and land-use changes.
- Exempt Replacing plumbing fixtures when no alterations to supply or drainage piping are needed
- Exempt Replacing electrical fixtures when no new wiring or circuits are needed
- Exempt Painting
- Exempt Replacing cabinets and countertops
- Exempt Pouring concrete patios or driveways at grade level (note: a zoning permit is still required)
- Exempt Replacing roofing materials on a single-family dwelling

- Fireplace installation manual (when applicable)
- Health Department septic and well approvals (where applicable)
- Water and sewer tap fee receipts (where applicable)
- Soils report (where required by site conditions)
- Floodplain, wetlands, Chesapeake Bay, or erosion and sediment materials (where triggered)
- Building code
- Virginia Uniform Statewide Building Code, current edition 2021, based on the ICC family of codes: 2021 International Building Code, 2021 International Residential Code and Fire Prevention Code, 2021 International Property Maintenance Code, 2021 International Mechanical Code, and 2021 International Plumbing Code.
- Permit validity
- A permit becomes invalid unless work begins within 6 months after issuance. The permit remains valid while regularly scheduled inspections continue. The Director of Inspections may grant written extensions of up to 6 months each for justified cause.
- Owner-builder
- The building or property owner, lessee, or agent may apply. The county also states the contractor should obtain the permit as part of the contract because the permit holder is responsible for code compliance.
- Contractor requirements
- Architects, engineers, contractors, and subcontractors must provide evidence they are properly licensed or registered by the Commonwealth of Virginia before obtaining permits. Verify contractor licenses at the Virginia DPOR lookup: http://www.dpor.virginia.gov/LicenseLookup/
Application process
Typical processing: Approximately 10 days for application review, depending on workload and completeness of the submittal.
- 01 Determine whether county zoning review, town zoning approval (for projects in Smithfield or Windsor), floodplain review, wetlands review, Chesapeake Bay review, Health Department approvals, or utility tap approvals are needed before permit issuance.
- 02 Create an OpenGov account and start the appropriate county application, or bring paper plans to Central Permitting at 17140 Monument Circle if not applying online.
- 03 Upload or submit the required plans and supporting documents, including the zoning permit or waiver, site plan, plan sets, engineered product cut sheets, septic or well approvals when applicable, water and sewer tap receipts when applicable, and a soils report when required.
- 04 County staff reviews the application. The county FAQ states the review time is approximately 10 days, subject to workload and completeness of the submittal.
- 05 Respond to review comments in OpenGov if corrections are requested.
- 06 Pay application, permit, and any reinspection fees through OpenGov by credit card or e-check, or use county in-person options where allowed.
- 07 Receive the issued permit and approved plans, then post the permit in plain sight at the job site.
- 08 Schedule inspections through OpenGov, the inspection hotline at 757-365-1666, or by email to to-inspect@iwus.net. Do not proceed to the next stage until work is approved.
