When a permit is required
Permit triggers and exempt work for Essex County
Essex County administers permits for new construction, additions, alterations, demolition, accessory buildings, manufactured homes, docks, commercial work, trade permits, land disturbance, floodplain development, and zoning or land-development approvals. The floodplain application states a permit is required for any activity or development in a floodplain district. Virginia's 2021 Virginia Uniform Statewide Building Code also requires permits for most construction, demolition, structural work, and many trade installations or changes.

Application process
Typical processing: Minimum 7 business days for building permit review per the county residential and commercial building permit applications.
- 01 Confirm whether the project needs a county building permit, a county zoning or land-development permit, a floodplain permit, or multiple approvals. The Building and Zoning office administers plan review, inspection, and certificate-of-occupancy issuance, and the county publishes separate building, erosion and sediment, floodplain, and zoning forms.
- 02 Download the correct county form set from the Building Applications and Forms or Zoning Applications and Forms pages. Core forms include the Residential Building Permit Application, Commercial Building Permit Application, Erosion and Sediment Control (Land Disturbing Permit) Application, Floodplain Development Permit Application, and Land Development and Zoning Permit.
- 03 Prepare the application package. Residential and commercial forms require owner and job-site information, scope of work, floodplain status, estimated cost, contractor information, Virginia contractor license numbers or owner affidavit, and trade information. The land-disturbance form requires a full erosion and sediment control plan unless the project qualifies for an Agreement in Lieu.
- 04 Submit the application to Essex County Building and Zoning before 4:00 p.m. The county states permit applications must be submitted by 4:00 p.m. so payment can be processed by 4:15 p.m.; applications are not accepted after 4:00 p.m.
- 05 County staff reviews the submission. The review period for building permit applications is a minimum of 7 business days. Additional zoning, land-disturbance, Chesapeake Bay, stormwater, or floodplain review may also be required depending on the site.
- 06 Provide proof of contractor licensure or a valid owner affidavit, and provide proof of required Essex County business licensing. Applicants doing work in Essex County may be denied service until proof of a county business license is shown.
- 07 Pay permit fees and obtain permit issuance. After approval, the county performs required inspections and issues a certificate of occupancy upon satisfactory completion where applicable.
Typical processing time: Minimum 7 business days for building permit review per the county residential and commercial building permit applications.
