When a permit is required
Permit triggers and exempt work for Dillwyn
A town zoning permit is required for any permitted use or structural alteration inside Dillwyn that must conform to the town zoning ordinance. All town departments and officials issuing permits or licenses must conform to the zoning ordinance. Where the project also involves building-code regulated work, a Buckingham County building permit is also required.
Note: No public Dillwyn zoning exempt-work list was found. Virginia USBC building-permit exemptions apply to the Buckingham County building-permit layer, but the town zoning ordinance should still be reviewed for land-use, setback, and district-compliance impacts. Contact the Town of Dillwyn Zoning Administrator at (434) 983-2076 before proceeding.
- Zoning permit application signed by the owner, contract-agent, or legal representative
- Description of proposed use and applicable zoning district classification
- Setback and district-compliance information
- Two copies of an acceptable site plan if required by the Zoning Administrator
- Any other reasonable information requested by the Zoning Administrator
- Building code
- The town zoning ordinance defines the Building Code as the Virginia Uniform Statewide Building Code, as adopted by the Town of Dillwyn and as amended. Building code administration for Dillwyn projects is handled by Buckingham County. The 2021 Virginia Uniform Statewide Building Codes became effective January 18, 2024.
- Permit validity
- Town zoning permits automatically expire six months after issuance if the permit has not been clearly exercised for the approved purpose, or if authorized work is suspended or discontinued for one year or more.
- Owner-builder
- No town-specific owner-builder rule was found. Virginia contractor law exemptions apply: a person may perform or supervise construction of no more than one primary residence owned by and for their own use during any 24-month period without a contractor license. USBC compliance is still required.
- Contractor requirements
- The town zoning ordinance does not publish a separate contractor-license rule for zoning permits. For the required Buckingham County building permit, state law requires proof of Virginia contractor licensure or a written exemption statement before permit issuance. DPOR's Board for Contractors regulates state licensing.
Application process
Typical processing: Not publicly stated by the town.
- 01 Confirm the property is inside the incorporated Town of Dillwyn rather than unincorporated Buckingham County.
- 02 Download the Town of Dillwyn zoning permit application from the town zoning documents page.
- 03 Prepare the zoning permit package. Identify the proposed use and whether it is a permitted use, a conditional use permit, or a variance-based request. Show setbacks and other district requirements to the Zoning Administrator's satisfaction.
- 04 Include two copies of an acceptable site plan if required by the Zoning Administrator. Minimum site plan items include lot dimensions, property monuments, existing and proposed structures, yard dimensions, uses, easements, watercourses, fences, street names, rights-of-way, and information about directly affected abutting properties.
- 05 Pay any applicable town zoning fee before submittal. The town ordinance states no permit will be reviewed until fees due, if applicable, have been paid. A public fee schedule is not posted; confirm the amount directly with Town Hall.
- 06 The Zoning Administrator reviews the application. If the proposal conforms, the Zoning Administrator signs and returns one copy of the zoning permit and site plan and retains the file copy. If the proposal does not conform, a written refusal citing the applicable ordinance sections is issued.
- 07 If the work also requires a building permit under the Virginia USBC, submit to Buckingham County Building Inspections at (434) 969-4242 after or together with town zoning clearance.
- 08 Complete all county building inspections. Schedule county inspections by calling (434) 969-4243 option 2.
- 09 Obtain final approval and any required certificate of occupancy from Buckingham County Building Department in coordination with the Town Zoning Administrator.
