When a permit is required
Permit triggers and exempt work for Washington County
Verified county permits are required for floodplain development in unincorporated areas, for all new, altered, repaired, or enlarged septic systems regardless of acreage, and for driveways or culvert work within county right-of-way. A blanket county general building permit requirement for all construction in unincorporated Washington County was not found in public sources.
- Exempt Development or construction outside the floodplain does not require a county floodplain permit
- Exempt Routine septic maintenance such as tank pumping does not require a septic permit
Note: No comprehensive public exempt-work list for general construction in unincorporated Washington County was found. The record reviewed supports floodplain, OSSF, driveway or culvert, and related development controls, not a blanket county building department exemption schedule.
- Floodplain application with deed, map, and other information defining the property and proposed development
- Septic checklist items including property information, soil evaluation, site plan, and system-specific materials
- Driveway or culvert application materials identifying the property, proposed driveway configuration, and culvert information
- Building code
- No public county ordinance was found that clearly establishes a countywide general building code enforcement program for all unincorporated construction. Verified county controls are floodplain, OSSF, right-of-way, and related development regulation programs.
- Permit validity
- The county floodplain application expires one year from the date of application if authorization or exemption has not been issued. No general county expiration rule was identified for septic or driveway approvals.
- Owner-builder
- No county owner-builder handout was found. Texas-context note: because Washington County does not publish a city-style county building permit and inspection program for all unincorporated residential construction, parcel-specific review can still matter for floodplain, septic, utility, lender, insurer, and private-inspection compliance questions, including possible HB 2833 issues on some residential projects.
- Contractor requirements
- No countywide general contractor licensing program was identified. OSSF work is governed by county OSSF rules and Texas licensing law where applicable.
