When a permit is required
Permit triggers and exempt work for Polk County
A permit is required for any man-made change to improved or unimproved real estate, including buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations, or storage of equipment or materials. A residential development permit must be obtained before building or adding any man-made structure or adding onto an existing structure. A residential development permit is also needed to obtain electric service for the structure. An elevation certificate is required before permits can be purchased when building in the floodplain. OSSF permits are required for septic installation or modification under county and state rules. Commercial development permits require Fire Marshal plan review first. A 911 address permit is required to establish a new physical address. Right-of-way permits are separately required where applicable.
Note: No public exempt-work list was found on the reviewed Polk County permit materials. The county instead publishes a broad permit trigger for man-made changes to real estate and separate rules for septic, floodplain, addressing, commercial review, and right-of-way matters.

- Building code
- No countywide adopted building code for ordinary construction was identified on the reviewed Polk County permit pages. The Permit Office profile ties county permitting to the Flood Damage Prevention Order, National Flood Insurance Program requirements, and OSSF rules under Texas Health and Safety Code Chapter 366 and 30 Texas Administrative Code Chapter 285. The Fire Marshal page states all new commercial buildings must be inspected and comply with NFPA 101, 2021 edition, and NFPA 1 fire life safety codes.
- Permit validity
- Residential development permit: good for two years from the date of purchase. The fillable permit application form states permit expires one year from the issue date unless revoked. Confirm the applicable expiration period with the Permit Department for the specific permit being requested.
- Owner-builder
- The county application authorizes county entry for lot and land evaluation, septic inspections, and flood hazard evaluation. The county page states deed restrictions remain the property owner's responsibility. For residential work in unincorporated areas, project-specific legal review may be warranted on any Texas HB 2833 private-inspection issues because Polk County publishes development and floodplain controls but does not publicly present itself as a full municipal-style building code department.
- Contractor requirements
- No countywide local contractor registration program was identified on the permit page. The public record reviewed does not show Polk County adopting a broad county contractor-licensing regime for ordinary building permits.
Application process
Application → plan check → issuance → inspection → final
- 01 Determine whether the parcel is in unincorporated Polk County and whether the project also needs septic, floodplain, right-of-way, commercial fire review, or 911 addressing approvals.
- 02 If the site is undeveloped or needs a new physical address, use the county's 911 address or combined residential development, septic, and 911 address permit forms as applicable.
- 03 Submit development and septic permits simultaneously. The county's permit page states this has been required effective October 22, 2024.
- 04 For commercial projects, complete plan review with the Polk County Fire Marshal before county commercial development permit approval.
- 05 If the property is in the floodplain, provide the required elevation certificate before permits can be purchased.
- 06 Submit the fillable PDF application to the Permit Department by email or in person, pay the applicable fee, and coordinate inspections.
- 07 Complete lot and land evaluation, septic inspections, flood hazard evaluation, and any other inspections required by the county's programs.

The fillable permit application references credit-card payment with a 3% service fee. If permit fee exceeds $500, the form provides specific payment-selection instruction for the county's payment workflow.
