When a permit is required
Permit triggers and exempt work for Newton County
All new development requires a Floodplain Development Application to be completed and processed prior to start of construction. This includes floodplain zone inquiries, new construction, subdivisions, RV parks, mobile homes, tiny homes, portable buildings, and substantial improvements. No public countywide general building permit program found outside these narrower controls.
Note: No public Newton County exempt-work list for building permits found. Reviewed county floodplain materials state that all new development requires a Floodplain Development Application before construction.
- Completed Sections 1 through 3 of the Floodplain Development Application
- Site development plans and elevation certificates (required for all new development)
- No-rise certification for regulatory floodway work (if applicable)
- Subdivision or mobile home park plans with base flood elevations (if development exceeds 50 lots or 5 acres)
- As-built elevation or floodproofing certificate at project completion
- Building code
- No public countywide adopted building code or general county building code enforcement program. Verified countywide construction control is the Newton County Flood Damage Prevention Order for floodplain development.
- Permit validity
- Floodplain development permits are valid for six months from date of issuance.
- Contractor requirements
- No public Newton County contractor registration or local contractor licensing program found. State trade licensing may still apply. For unincorporated residential projects where governmental inspections are required, Texas Local Government Code Chapter 233 private-inspection rules may also be relevant.
