When a permit is required
Permit triggers and exempt work for Kent County
No public Kent County source was found establishing a countywide general building permit requirement for ordinary construction in unincorporated areas. For OSSF or septic systems, TCEQ states that a permit and approved plan are required to construct, alter, repair, extend, and operate an OSSF.
- Exempt 10-acre rule exemption if all TCEQ conditions are met
- Exempt Emergency repairs listed by TCEQ, if reported in writing to the permitting authority within 72 hours after repairs begin
- Exempt Certain grandfathered OSSFs may not need a permit if they meet TCEQ's stated conditions
Note: These exemptions apply specifically to OSSF or septic systems under TCEQ regulation. No public exempt-work list was found for a Kent County general building permit program because no public countywide general building permit program was identified.
- For OSSF work: application and planning materials as required by TCEQ
- Site evaluation conducted by a TCEQ-licensed site evaluator or a professional engineer for the 10-acre exemption analysis and related design work
- Owner-builder
- TCEQ states owner-installation can be allowed only in limited circumstances for the owner's single-family residence and still requires coordination with the permitting authority.
- Contractor requirements
- OSSF installers and related personnel are regulated by TCEQ licensing rules. State trade licenses may still apply for plumbing, electrical, HVAC, and similar regulated work.
