When a permit is required
Permit triggers and exempt work for Jim Wells County
The county Safety page expressly covers permitting, maintenance, and construction requirements for on-site sewage facilities. The county flood damage prevention order requires a floodplain development permit for development in regulated flood hazard areas. The county's posted builder guidance states that in unincorporated Jim Wells County no permit or certificate of occupancy is required for building construction, plumbing, or electrical work if ALL of the following conditions are met: (1) the structure is not in a flood zone, (2) no city utilities are used, (3) the structure is not for commercial use, and (4) it is not for public use.
- Exempt Ordinary construction not in a flood zone, not using city utilities, not for commercial use, and not for public use does not require a building or certificate of occupancy permit
Note: This limitation applies only if ALL conditions are met: (1) not in a flood zone, (2) not using city utilities, (3) not commercial, and (4) not public-use. Floodplain and OSSF work may still require permits and approvals.
- For OSSF: owner information, legal description, site address or directions, application type, system and lot information, installer and site evaluator information, and supporting technical materials
- For floodplain work: plans in duplicate drawn to scale showing location, dimensions, elevation, lowest-floor, floodproofing, drainage, and watercourse information as applicable
