When a permit is required
Permit triggers and exempt work for Delta County
No verified countywide general building permit for ordinary residential or commercial building construction. Verified county permit controls include: OSSF permits and authorizations to construct; floodplain development permits before construction within county's stated floodplain trigger area; driveway/culvert permits for access work on county road easements/rights-of-way; road bore/cut/utility right-of-way permits for utilities in county roads; development permits and related approvals for temporary rental communities/RV parks and subdivision-related development under 2025 Development Rules and Regulations; boarding home facility permits.
Note: No public county exempt-work list for ordinary building construction. County does not publish a general county building-permit program. Verified public record supports narrower permit triggers for OSSF, floodplain, county ROW/driveway work, utility installations in county roads, and specific development programs.
- OSSF: contact Designated Representative for applicable packet and fees
- Floodplain: contact floodplain administrator before any permitting, development, and/or construction within 200 feet of a floodplain
- Driveway/culvert: county permit application, site and owner information, 911 address first, inspection acknowledgment
- Road bore/utility ROW: application describing work, design drawings, traffic control measures, utility details, contact information, proof of insurance; restoration bond may be required
- Temporary rental community/RV park development: seven hard copies and one PDF of Infrastructure Development Plan, survey, deed, surveyor/engineer contact details, utility letters, TXDOT driveway approval if applicable, OSSF suitability materials if applicable, flood information, and other listed items
- Building code
- No countywide general building code adoption. County rules reference narrower technical frameworks: TCEQ OSSF rules, FEMA and TWDB floodplain standards, state utility/transportation statutes, Texas Manual on Uniform Traffic Control Devices for ROW work, and state permits for public utility systems.
- Permit validity
- Development permits valid one year from issuance. Septic authorizations to construct valid one year from issuance. Driveway/culvert permits require work to commence within three months and be completed within six months from permit date. No publicly stated fixed expiration period for road bore/cut/utility ROW permits.
- Owner-builder
- No countywide owner-builder rule for general vertical construction (county does not publish general building-permit program). Owner-builders in unincorporated areas should separately evaluate state-law and lender/insurer requirements, including whether Texas HB 2833 private-inspection rules apply.
- Contractor requirements
- No countywide general contractor registration program for ordinary building construction. For specific permits, county forms request contractor and installer information. State licensing and trade-specific law apply where regulated.
