When a permit is required
Permit triggers and exempt work for Pine Ridge (Tribal Community)
A Tribal Environmental Review Permit is mandatory for any development on tribal trust land that results in a significant change to a structure's use or appearance, or to a land site's use or appearance. Development is prohibited unless an Environmental Review Permit is obtained from the Tribe.
- Exempt Tribal members conducting traditional religious activities are exempt from Environmental Review Permit requirements.
Note: Exemptions are strictly limited to traditional religious activities. All other development, including residential, commercial, industrial, agricultural improvements, and infrastructure, requires Environmental Review Permit approval.

- South Dakota state building codes do not apply on tribal trust land. Oglala Sioux Tribe maintains its own regulatory framework. - Permit validity
- Permits are subject to approval conditions set by the Environmental Health Technical Team. Permits may be appealed within 10 working days of denial or conditional approval. Tribal Court review is available based on code compliance or arbitrary determination.

- Tribal members conducting traditional religious activities are exempt from the Environmental Review Permit requirement.
- Contractor requirements

- 08 If dissatisfied with approval conditions or if permit is denied, applicants may appeal to the Tribal Appeals Committee within 10 working days.
