When a permit is required
Permit triggers and exempt work for Newport
Per Rhode Island General Law section 23-27.3-113.1, a permit is required to construct, enlarge, alter, repair (beyond ordinary repairs), remove, or demolish any building or structure, or to change occupancy. Electrical, plumbing, and mechanical work requires specialty permits.
- Exempt Ordinary repairs as defined in RI General Law section 23-27.3-102.0 that do not violate any provision of the building code
- Exempt Interior painting, wallpapering, carpeting, and cabinet installation (no structural or mechanical changes)
- Exempt Replacement of flooring (no structural work)
- Exempt Minor landscaping and yard work not involving grading or drainage alterations
- Exempt Fences not exceeding 6 feet in height
- Exempt Prefabricated pools under 24 inches deep
Note: Newport's historic district overlay means that even exempt work may require Historic District Commission review if it alters the exterior appearance of a contributing structure
- Completed application
- Site plan showing property dimensions, lot coverage, setbacks, and location of all structures
- Construction plans (foundation, floor plan, elevations, sections, structural details)
- Engineered calculations for beams/trusses where applicable
- Elevation certificate if in a flood zone
- Contractor registration number (RICRLB)
- Any required state or local agency approvals
- Historic District Commission Certificate of Appropriateness if applicable
- Building code
- Rhode Island State Building Code (based on International Building Code with Rhode Island amendments); Rhode Island also adopts the International Energy Conservation Code (IECC) 2024 for new construction and renovations
- Permit validity
- Permits expire if work is not commenced within six months of issuance or if work is abandoned for six months; extensions may be requested
- Owner-builder
- Homeowners may pull permits for work on their primary owner-occupied residence. An owner-builder affidavit is required. Homeowners may not pull permits for rental properties or speculative construction.
- Contractor requirements
- All contractors must be registered with the Rhode Island Contractors' Registration and Licensing Board (RICRLB), 560 Jefferson Boulevard, Warwick, RI 02886; https://crb.ri.gov/. Registration fee is $150; requires general liability insurance ($500,000 minimum), workers' comp if employees, and completion of a 5-hour pre-registration course (commercial-only contractors are exempt from the course). Electrical and plumbing contractors must hold separate state trade licenses.

- 01 Determine whether a permit is required and whether the property is in a historic district or flood zone.
- 02 If in a historic district, obtain a Certificate of Appropriateness from the Historic District Commission before submitting a building permit application.
- 03 Create an account at https://newportri.viewpointcloud.com/
- 04 Complete the online application and upload all required documents (plans, site plan, elevations, etc.).
- 05 Pay applicable fees online.
- 06 Application is reviewed for zoning compliance and code compliance; incomplete applications are returned.
- 07 Permit is issued (or additional information requested).
- 08 Post permit on job site and begin work.
- 09 Call for required inspections at each phase of construction.
- 10 Final inspection and certificate of occupancy/completion issued upon project completion.
