When a permit is required
Permit triggers and exempt work for Clay County
Permits are required for residential and commercial construction, additions, remodels, trade work, accessory buildings, pools, demolition, signs, generators, solar, and floodplain-related work.

- Permit validity
- The fee schedule indicates a void permit due to inactivity cannot be renewed; a new permit may be issued for 50% of current fee schedule if the original plan is unchanged.
- Owner-builder
- If the applicant owns the land and proposed home and intends to occupy for one year after completion, the applicant may act as own contractor.
- Contractor requirements
- Valid NC State Contractor's License Number is required, with trade installer license numbers required for trade work.

- 02 Prepare permit documents and plans.
- 03 For residential applications, submit during the online submission window or county office windows stated by the Building Inspections Office.
- 04 If in Town of Hayesville city limits or ETJ, obtain a valid town zoning permit before county issuance.
- 05 If in FEMA AE flood zone, apply for a Floodplain Development Permit and submit the FEMA Elevation Certificate.
- 06 If on private well or septic, obtain Clay County Environmental Health approvals first.
- 07 Submit application, plans, contractor and trade information, and utility letters.
- 08 Commercial plans are reviewed first-come, first-served after acceptance.
- 09 County notifies the applicant by call, fax, or email when approved and ready for issuance.
