When a permit is required
Permit triggers and exempt work for Truth or Consequences
New construction, additions, structural alterations and repairs, demolition, reroofing, accessory structures (garages, sheds, outbuildings), fences above certain heights, manufactured home installation, and all trade work (electrical, plumbing, mechanical, gas). Contact City Hall to confirm current list of permit-triggering work types.
- Exempt Standard IBC exemptions apply for minor cosmetic work (painting, flooring, non-structural finishes) under IBC Section 105.2
Note: Contact City Hall for confirmation before commencing any work without a permit.
- Completed building permit application
- Site plan showing property boundaries, building footprint, setbacks, driveways

- Building code
- Truth or Consequences has adopted New Mexico state building codes as the baseline. State-adopted codes effective as of July 2024 include 2021 IBC, 2021 IRC, 2020 NEC, 2021 IMC, and 2021 IPC with NM amendments. Contact City Hall to confirm any local amendments or additional ordinances. City zoning ordinances govern setbacks, land use, and permitted structures by zone.
- Permit validity
- Standard NM/IBC practice: permit expires if work does not commence within 180 days of issuance or if work is suspended for 180 consecutive days. Verify current policy with City Hall.
- Owner-builder
- Owner-builder (homeowner) permits are available per 14.5.2.18 NMAC. Owner must intend to occupy the completed structure as primary residence; limit of one permit per 12-month period; notarized homeowner application required. Contact City Hall to confirm current local requirements.
- Contractor requirements
- All construction work must be performed by NM-licensed contractors. GB-2 for residential (up to four units); GB-98 for general commercial building. Trade licenses required for electrical, plumbing, and mechanical work.
