When a permit is required
Permit triggers and exempt work for Sandoval County
Any new construction, addition, structural alteration, repair, demolition, re-roof, solar, or change of occupancy for structures over 120 sq ft. Manufactured home placement also requires a permit.
- Exempt One-story detached accessory buildings (tool sheds, playhouses) with floor area 120 sq ft or less
- Exempt Fences not exceeding 6 feet in height
- Exempt Retaining walls retaining less than 36 inches of unbalanced fill and total height 6 feet or less from top of wall to bottom of footing
- Exempt Platforms, walks, and driveways not more than 30 inches above grade
- Exempt Painting, papering, tiling, carpeting, cabinets, countertops, and similar finish work
- Exempt Work not otherwise regulated by the New Mexico Building Code
- Completed NM CID building permit application
- Sandoval County P+Z Zoning Compliance Approval letter (signed)
- Floodplain determination (included in P+Z review)
- Two complete sets of construction plans drawn to minimum 1/4" = 1 ft scale
- Site plan showing property lines, setbacks, and structure location
- For homeowner permits: notarized Homeowner Permit Responsibilities and Liabilities Acknowledgement form
- Liquid Waste Disposal Permit from NM Environment Department if applicable
- Elevation Certificate from licensed surveyor if property is in a flood zone
- Building code
- New Mexico Residential Code (based on IRC); New Mexico Commercial Building Code (based on IBC); state-adopted codes enforced by CID statewide.
- Permit validity
- Permit expires if work not commenced within 180 days of issuance. Permit becomes inactive if work suspended for 180+ days. Permits expire on the first day of the 13th month after issuance.
- Owner-builder
- Homeowner permit available for owner-occupied single-family residence only. Applicant must apply in person at CID. Must submit notarized Homeowner Permit Responsibilities and Liabilities Acknowledgement form. Homeowner may self-perform work or use W-2 employees. HVAC and natural gas work is NOT available under homeowner permit.
- Contractor requirements
- All contractors must hold a valid NM RLD Construction Industries license. GB-2 Residential license (2 years experience required) covers single-family and small multifamily. GB-98 General Building license (4 years experience) covers all building types. Specialty trades require separate NM state licenses. $10,000 contractor bond required. Workers compensation insurance required.
Application process
Typical processing: Residential: 3-5 business days at CID after submittal is complete. County P+Z review: typically 5-10 business days.
- 01 Submit Zoning Compliance and Floodplain Determination Checklist to Sandoval County P+Z. Fee: $75 (residential, no address) or $80 (with address assignment).
- 02 Sandoval County P+Z reviews zoning, setbacks, floodplain, and land-use compliance.
- 03 Upon P+Z approval, gather construction documents and plans.
- 04 Submit completed NM CID Multi-Purpose State Building Permit Application, zoning approval letter, and two complete sets of construction plans (min. 1/4" = 1 ft scale) to CID.
- 05 CID reviews and approves. Residential permits typically processed within 3-5 business days.
- 06 CID issues building permit and trades permits (electrical, mechanical, plumbing) as applicable.
- 07 Schedule inspections through NM CID as work progresses.
- 08 CID issues Certificate of Occupancy upon successful final inspection.
Typical processing time: Residential: 3-5 business days at CID after submittal is complete. County P+Z review: typically 5-10 business days.
