When a permit is required
Permit triggers and exempt work for Portales
A building permit is required for all new construction, additions, alterations, structural repairs, demolitions, and changes of occupancy within Portales city limits. Separate trade permits are required for electrical, plumbing, and mechanical work. Fence permits, sign permits, and demolition permits may be required as well.
- Exempt Minor repairs and finish work: Painting, flooring, tiling, cabinet installation, and similar cosmetic work typically do not require a permit.
Note: Confirm with the building department if in doubt about whether a project requires a permit.
- Completed City of Portales permit application form
- Site plan showing property lines, setbacks, proposed work location, and existing structures
- Construction drawings (floor plans, elevations, sections, structural details as applicable)
- Foundation plan
- Energy compliance documentation per current NMAC/IECC requirements
- Contractor information including NM CID license number for each contractor
- Homeowner permit affidavit if owner-builder
- Additional documents as required by the building official for specific project types
- Building code
- City of Portales adopts NM state building codes (2021 IBC, 2021 IRC, 2020 NEC, 2021 UPC, 2021 IMC, and NMAC amendments) as the baseline. Local amendments may apply. Reference: https://library.municode.com/nm/portales/codes/code_of_ordinances. Confirm current adopted code editions with the building department.
- Permit validity
- Permits typically expire if work does not commence within 180 days of issuance or if work is abandoned or suspended for 180 consecutive days. Confirm current expiration policy with the Portales Building Department.
- Owner-builder
- Homeowners may obtain a homeowner building permit for their own primary residence per NMAC 14.5.2.18. Only one homeowner permit per owner per 12 months. Homeowners may perform general construction work; electrical and plumbing may be performed by the homeowner under a homeowner trade permit only if the homeowner personally does the work. HVAC and gas work must be done by licensed contractors.
