When a permit is required
Permit triggers and exempt work for Lea County Unincorporated Area
All new construction, additions, alterations, demolitions, electrical, plumbing, and mechanical work in unincorporated Lea County. Floodplain development of any kind (including grading, filling, paving, structures) requires a county floodplain permit per Flood Damage Prevention Ordinance (County Ordinance 70).
- Exempt One-story detached accessory structures not over 120 sq ft with no utility connections (tool sheds, playhouses)
- Exempt Oil derricks
- Exempt Retaining walls not over 36 inches in height measured from bottom of footing to top of wall, total height not exceeding 6 feet, not supporting a surcharge load
- Exempt Water tanks supported directly on grade, capacity 5,000 gallons or less, height-to-diameter ratio 2:1 or less
- Exempt Sidewalks and driveways not more than 30 inches above adjacent grade and not over a basement or story below
- Exempt Temporary motion picture, television, and theater stage sets and scenery
- Exempt Above-ground prefabricated swimming pools accessory to a one- or two-family dwelling, less than 24 inches deep, 5,000 gallons or less, not equipped with a filtration system
- Exempt Shade cloth structures for nursery or agricultural purposes, not including service systems
- Exempt Swings and playground equipment accessory to one- or two-family dwellings
- Exempt Window awnings supported by an exterior wall of Group R-3 or U occupancies, not projecting more than 54 inches
- Exempt Nonfixed and movable fixtures, cases, racks, counters, and partitions not over 5 feet 9 inches in height
Note: Agricultural buildings in rural Lea County may have additional exemptions. Contact Lea County Planning (575-396-8696) or CID for guidance on agricultural and oil field accessory structures common in this region.

- Permit validity
- Per 14.5.2 NMAC: expires if work not commenced within 180 days of issuance or suspended more than 180 days. Extensions of up to 180 days may be granted.
- Owner-builder
- State Homeowner Building Permit (14.5.2.18 NMAC) available for primary residences. Owner must complete the major portion of work by dollar value. Maximum one homeowner permit per 12-month period. Electrical requires passing a competency exam (75% pass score). HVAC, natural gas, and LP gas work excluded.
- Contractor requirements
- NM CID license required. A person without a current valid CID license is not eligible to apply for or be issued a permit (except homeowners under 14.5.2.18). License classes: GB-2 (residential), GB-98 (general commercial). Specialty trades require separate NM trade licenses.

Application process

- 01 Submit addressing/new construction application to Lea County Environmental Services. Complete pages 2 and 5 of the Lea County Application, include a site plan showing all existing and proposed structures with measurements, a copy of the warranty deed, and owner's driver's license.
- 02 Submit by drop-off at 1019 E. Bender Blvd., email to vtrujillo@leacounty.net, or fax to 575-391-8764.
- 03 County Environmental Services establishes address coordinates, assigns 911 addressing, and reviews for floodplain compliance. Applicant will be notified by mail, email, or fax.
- 04 Contact Lea County Planning at (575) 396-8696, jportulano@leacounty.net to confirm zoning and land use compliance. Subdivision review may be required for new parcels.
- 05 Complete the NM State CID Multi-Purpose State Building Application (available at https://www.rld.nm.gov/construction-industries/forms-and-applications/).
- 06 Submit the CID application (with county ordinance clearance documentation) to the state CID Las Cruces office (505 S. Main, Suite 118, Las Cruces, NM 88004, 575-524-6320) or Santa Fe office.
- 07 CID calculates project valuation and permit fee, issues permit.
- 08 Post permit on site and schedule inspections with CID via https://www.rld.nm.gov/construction-industries/inspection-request/.
- 09 Pass required inspections at each construction phase.
- 10 Receive Certificate of Occupancy from CID upon final inspection approval.

Fees paid to the state CID at time of permit issuance. Lea County does not charge a separate building permit fee for its compliance review role.

Typical sequence: (1) Foundation/footing after excavation and rebar in place; (2) Under-slab or under-floor plumbing and mechanical before slab pour; (3) Framing/rough-in after roof, framing, fire blocking, bracing, and rough electrical/plumbing/mechanical complete; (4) Insulation; (5) Final inspection for certificate of occupancy. Roofing: (a) decking inspection after removal of existing roofing, (b) final roofing. Solar/wind systems: structural inspections if reinforcement required.
