When a permit is required
Permit triggers and exempt work for York County
Any building, structure, or land use established, erected, constructed, reconstructed, enlarged, moved, or structurally altered in unincorporated York County requires a Zoning Permit first issued by the Zoning Administrator. Exempt from Zoning Permit (but require a Certificate of Zoning Compliance): non-residential farm buildings on qualifying farms (20+ acres, $1,000+/year farm products). Public entity structures within public rights-of-way or easements of record do not require Zoning Permits. No building code enforcement at the county level.
- Exempt Non-residential farm buildings on qualifying farms (20+ acres producing $1,000+/year in farm products) - require only Certificate of Zoning Compliance (not full Zoning Permit)
- Exempt Public entity structures (road signs, bridges, culverts) within public rights-of-way or easements of record
Note: Farm buildings used for any non-agricultural purpose, or located on land that does not meet the farm definition, are NOT exempt and require a full Zoning Permit. Waste handling facilities associated with farm buildings always require a Zoning Permit.
- Completed Zoning Permit application form
- Plot plan: actual dimensions and shape of lot; locations and sizes of all existing and proposed structures, parking, water supply, sewage disposal
- Description of existing and proposed land use
- Water supply and sewage disposal provisions (NDEE Title 124 compliance may be required for septic)
- Erosion control and soil permeability information as applicable
- If floodplain involved: elevations of lowest floor (including basement), flood-proofing certifications, and compliance documentation
- Permit validity
- Permitted work must begin within one (1) year of permit issuance or the permit expires.
- Contractor requirements
- No county-level contractor licensing; Nebraska Contractor Registration Act applies statewide for contractors with one or more employees ($25/year registration, workers' compensation insurance required).
