When a permit is required
Permit triggers and exempt work for Polk County
Any constructing, reconstructing, enlarging, alteration, or moving of any structure or building in all areas within Polk County Zoning Jurisdiction. Includes new construction of any building (residential, accessory, commercial, agricultural subject to exemption); additions to existing structures; and structural alterations or relocations.
- Exempt Agricultural building exemption: Structures on farmsteeds of 20 or more acres producing $1,000 or more per year in farm products are exempt from county building permits (Neb. Rev. Stat. § 23-114.03). This exemption applies only to county permits; state-level requirements (Fire Marshal, electrical, septic) still apply.
Note: Applicability of agricultural exemption must be confirmed with Polk County Zoning Office for each specific parcel.
- Completed county permit application
- Site plan (property lines, structure location, setbacks, road access, existing structures)
- Construction plans or drawings for structural work
- Contractor information (name, Nebraska DOL registration number, workers' compensation certificate) if using a contractor
- Building code
- Polk County enforces zoning and structural requirements under Comprehensive Land Use Ordinance No. 24-21. State default code (Nebraska State Building Code, IBC/IRC) applies if no specific local adoption is in force. Confirm applicable structural standards with Zoning Office.
- Owner-builder
- Property owners may generally perform work on their own property. For electrical work, NSED homeowner permit process applies. Confirm with Zoning Office for any project-specific requirements.
- Contractor requirements
- No Nebraska general contractor license. All contractors must be registered with the Nebraska Department of Labor (https://dol.nebraska.gov/conreg). Electrical contractors: NSED license required. Plumbers: Nebraska DOL Plumbing Division license required.

- 01 Confirm the parcel is in unincorporated Polk County (outside all city and village limits). If near a boundary, confirm jurisdiction with both the municipality and Zoning Office.
- 02 Contact Polk County Planning & Zoning at (402) 747-2921 to describe the project and obtain the correct application form(s).
- 03 Prepare required documentation: site plan showing property lines, proposed structure footprint, setbacks, access, and existing structures; construction plans or sketch for structural work; contractor information and Nebraska DOL registration number if using a contractor.
- 04 Submit completed application in person at Courthouse Zoning Office (400 Hawkeye Street, first floor). Office hours: Monday–Friday, 7:00 a.m.–3:30 p.m. (closed 12:00–12:30 p.m.).
- 05 Pay applicable permit fee per the fee schedule.
- 06 Await review and permit issuance. Contact Zoning Office for current processing times.
- 07 Post the permit on the job site once issued.
- 08 Schedule required inspections at appropriate construction milestones.
