Permit triggers and exempt work for Hamilton County
A zoning permit is required for new structures, additions, and structural changes within Hamilton County's zoning jurisdiction. Note: Hamilton County zoning permits are land-use compliance documents only — they verify that a proposed structure or use conforms to zoning regulations (district, setbacks, use classification) but do NOT constitute structural building code plan review or enforcement. There is no county-level building inspection for structural work in unincorporated areas.
- Exempt Agricultural buildings on farmsteads of 20+ acres producing $1,000+/year in farm products (per Neb. Rev. Stat. § 23-114.03). An Agricultural Building Exemption Form is available through the county zoning office. Note: The exemption applies to the zoning permit requirement, but state electrical (NSED) and floodplain requirements still apply.
Note: The agricultural exemption does not apply to: electrical permits (NSED still required), floodplain development permits (required in Special Flood Hazard Areas), and on-site wastewater registration (DWEE requirement is statewide). Confirm applicability of exemptions with the Zoning Administrator before proceeding.

- 01 Confirm the parcel is in unincorporated Hamilton County and not within any village or city limits, and not within Aurora's one-mile extraterritorial zoning zone.
- 02 Contact the Zoning Administrator to discuss the project and confirm which permit type(s) are required.
- 03 Download the applicable application form (Zoning Permit, Floodplain Development Permit, etc.) from the county website or pick up in person at the courthouse.
- 04 Complete the application with property owner information, legal description, proposed use, setback dimensions, and any relevant site plan or sketch.
- 05 For floodplain development, submit the Floodplain Development Permit application concurrently.
- 06 Submit the completed application with supporting documents and pay the applicable fee.
- 07 The Zoning Administrator reviews for land-use compliance. If a conditional use or rezoning is required, the application proceeds to the Joint Planning Commission for a public hearing (third Tuesday of each month, 7:30 p.m.).
- 08 Upon approval, the zoning permit is issued. 911 address assignment is coordinated by the Zoning Department for new structures.
- 09 Post the permit on site. For electrical work, obtain a separate permit from the Nebraska State Electrical Division (NSED) District 10 Inspector.
- 10 For septic systems, file a separate on-site wastewater registration with Nebraska DWEE ($140 fee).
