When a permit is required
Permit triggers and exempt work for Butler County
As of March 2026, Butler County has no enacted countywide zoning regulations and no structural building permit program for unincorporated areas. The Planning Commission (established late 2025) is developing a comprehensive plan and possible zoning regulations (estimated 9-10 months). However, statewide permits remain mandatory.
- Exempt Agricultural building exemption: Structures on farmsteads of 20+ acres producing $1,000+/year in farm products are exempt from building permits per Nebraska Revised Statutes § 23-114.03. This exemption will remain a relevant carve-out once county zoning is adopted. Exemption does not cover electrical, floodplain, or wastewater requirements.
Note: Although unincorporated Butler County currently has no county building permit program, statewide permits for electrical, wastewater, fire safety, and stormwater are still required. Agricultural exemptions apply only to the building permit component, not to these statewide requirements.
- Building code
- No county-level building code is adopted or enforced in unincorporated Butler County. Nebraska's state code (IBC 2021 Chapter 13 / IBC 2018 for other chapters; IRC 2021 Chapter 11 / IRC 2018 for other chapters) is available but not enforced by the county. Property owners are responsible for structural soundness. Lenders may impose their own inspection requirements.
